SUBJECT:                  Ordinance vacating Unit 6, Phase VII, Lots 726 through 763 and Tracts I and a portion of Tract J and including Tumbleweed Trail and Linen Bluff of Legacy of Leesburg subdivision plat

 

 

Staff Recommendation: 

The Planning staff and Planning Commission recommend approval of the request for vacating the referenced lots, tracts and streets in Legacy of Leesburg Unit 6, Phase VII subdivision plat.

           

Analysis:

The vacation of the referenced plat with 38 residential lots on approximately 8.8 +/- acres is requested by Richard Rodgers, Vice President – Rodgers Brothers Land Company, the owner of the property. This property is generally located south of C.R. 48 off of Meandering Trails Boulevard in Section 13-20-24. The lots to be vacated are currently undeveloped. Utility easements shall remain along the adjacent property lines for existing and/or required utility service(s) for these lots.

 

By a vote of 6 to 0, the Planning Commission recommended approval.

 

Options:        

1.         Approve the request to vacate Unit 6, Lots 726 through 763 and Tracts I and a portion of Tract J and including Tumbleweed Trail and Linen Bluff in the referenced subdivision.

2.         Other action the Commission may deem appropriate.

 

Fiscal Impact

No fiscal impact is anticipated as a result of the vacation of these subdivisions.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, VACATING UNIT 6, PHASE VII, LOTS 726 THROUGH 763 AND TRACTS I AND A PORTION OF TRACT J AND INCLUDING TUMBLEWEED TRAIL AND LINEN BLUFF OF LEGACY OF LEESBURG SUBDIVISION PLAT IN PLAT BOOK 58, PAGES 77 AND 85, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA, SAID PROPERTY GENERALLY LOCATED SOUTH OF C.R. 48 OFF OF MEANDERING TRAILS BOULEVARD, LYING IN SECTION 13, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE.

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1.

 

The City Commission of the City of Leesburg, Florida, finding that the vacating of 38 residential lots on approximately 8.8 +/- acres of Unit 6, Phase VII, Lots 726 through 763 and Tracts I and a portion of Tract J and including Tumbleweed Trail and Linen Bluff, of Legacy of Leesburg Plat, a subdivision in Lake County, Florida, are not needed for public purposes, therefore the referenced lots for Legacy of Leesburg Subdivision Plat, legally described below are hereby vacated except as reserved hereinafter:

 

Legal Description of Lots to be vacated:

Unit 6, Lots 726 through 763 and Tracts I and a portion of Tract J and including Tumbleweed Trail and Linen Bluff, of Legacy of Leesburg, Plat Book 58, Pages 77 & 85, a Subdivision in the City of Leesburg, in Section 13, Township 20 South, range 24 East, Lake County Florida.

 

Section 2.

 

            The City Commission specifically reserves in perpetuity, for the use and benefit of the City of Leesburg, utility easements for any areas where there are utility lines (above ground or underground) now in existence on the property, as well as utility easements over and across any and all roads, streets and alleys otherwise vacated by this Ordinance.

 

Section 3.

 

This ordinance shall become effective upon its passage and adoption according to law.
