Subject: Resolution amending Resolution 8519 Memorandum of Agreement with Florida Department of Transportation (FDOT) for reimbursement to the City for maintenance of non-landscaped portion of HWY 441 from College Drive to CR 473/ Bluegill Drive
Staff Recommendation:
Staff recommends approving the amended Memorandum of Agreement (MOA) with Florida Department of Transportation (FDOT) for reimbursement to the City for maintenance of non-landscaped portion of HWY 441 from College Drive to CR 473/ Bluegill Drive
Analysis:
On September 28, 2009 the City Commission approved Resolution 8519, an MOA with FDOT to reimburse the City for maintenance of the non-landscaped portion of HWY 441 from College Drive to CR 473/Bluegill Drive. The original agreement included verbiage allowing for an increase in reimbursement up to seven and one half (7.5) percent. In September of 2009, a Legislative Order came down to the Florida Department of Transportation (FDOT) whereby a ‘No Escalation’ directive was enacted on all FDOT contracts which includes contracts with Local Governments such as Memorandum of Agreements (MOA’s). This ‘No Escalation’ directive eliminates the opportunities for those holding contracts with FDOT to request an increase in reimbursement funding upon renewal
Options:
1. Approve the amended MOA or;
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Approval of the amended MOA will provide reimbursement of $9,156.00 annually for non-landscaped maintenance of Hwy 441 from College Drive to CR 473/Bluegill Drive for the three-year period. The Fiscal Year 2009-10 budget includes this revenue and associated expenses.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG FLORIDA, AMENDING RESOLUTION 8519 MEMORANDUM OF AGREEMENT (MOA) TO DELETE THE PARAGRAPH REGARDING THE POSSIBLE 7.5% INCREASE TO THE CONTRACT WITH FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) FOR REIMBURSEMENT TO THE CITY FOR THE MAINTENANCE OF NON-LANDSCAPED PORTION OF HWY 441 FROM COLLEGE DRIVE TO CR 473/BLUEGILL DRIVE; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an amended Memorandum of Agreement to delete the paragraph regarding the possible 7.5% increase to the contract with the Department of Transportation whose address is 1450 Thomas Ave, Leesburg, FL 34748 for reimbursement of $9,156.00 to provide maintenance for non-landscaped portions of Hwy 441 from College Drive to 473/Bluegill Drive
The term of this agreement shall be for a period of three years. This agreement may be renewed for a period that may not exceed three years with no increase in reimbursement. This is in accordance with the “no escalation” directive recently implemented by FDOT which required an amendment to Page 6 of the original agreement.
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the _26____ day of __October__ 2009.
