Subject: Resolution authorizing execution of an agreement with Dave Foote Environmental Construction, Inc. for the Plantation Master Lift Station construction
Staff Recommendation:
Staff recommends approval of the resolution authorizing execution of an agreement with Dave Foote Environmental Construction, Inc. for the Plantation master lift station construction for $315,280.31.
Analysis:
The project involves onsite improvements to the Plantation Wastewater Treatment Facility including construction of a new master lift station. Once completed the existing treatment facility will be decommissioned. Currently, the Plantation wastewater system is served by an on-site treatment facility. This facility is currently over capacity which runs a higher risk for spills and is also more costly to operate. The Plantation facility incurs an additional $4,000 to $6,000 in additional costs each month operating the treatment facility for such things as electricity, chlorine, laboratory analyses, and sludge hauling costs.
When the City performed its due diligence evaluation of the Plantation utilities prior to purchase of the system, the existing wastewater treatment plant was immediately identified as being inadequate and disproportionately expensive to operate. Staff determined the system would have to replaced in the near future or substantially upgraded. Since the Turnpike Wastewater Treatment Facility has excess capacity, and the Plantation wastewater flow could be diverted and treated very economically by the Turnpike facility, this was the more cost-effective choice. By diverting flow to the Turnpike facility, the City would avoid the substantial capital costs of upgrading a facility that would always be less cost-effective than the Turnpike facility. Therefore, this project was designed and permitted as the more cost-effective choice.
Construction of the new master lift station will allow the sewage from Plantation to be pumped to the Turnpike facility. Processing of the wastes at the Turnpike facility will eliminate the excess costs of nearly $72,000 per year. The risk of spills and corresponding DEP fines is greatly reduced with the construction of this lift station if not eliminated.
Procurement Information:
On September 8, 2009, the Purchasing Division issued Invitation to Bid number 90241. Notification of this opportunity by legal advertisement in the Daily Commercial was made. As well as posting on-line at BidSYNC.com.
On October 13, 2009 sealed bids were received from eight prospective contractors. Bids were evaluated by both the purchasing staff and the engineer of record on the project, AECOM, USA. Project references provided by the low bidder were verified by the engineer. The engineer has recommended award to Dave Foot Environmental as the lowest responsive and responsible bidder. City staff concurs with the recommendation of the engineer.

The Local Business Enterprise (LBE) preference was not a factor in this bid evaluation. The applicable 1% preference would have required a local vendor to submit a bid of no more than $318,433.11. Only Utility Systems Construction, Inc. qualified as a LBE.

Fiscal Impact:
This project is funded from available 2007 bond funds which will be rolled from fiscal year 2008-09.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH DAVE FOOTE ENVIRONMENTAL CONSTRUCTION, INC. TO PERFORM PLANTATION MASTER LIFT STATION CONSTRUCTION SERVICES; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an agreement with Dave Foote Environmental Construction, Inc. whose address is 6091 Greenbriar Farms Road, Ft. Myers, Florida 33905for Plantation Master Lift Station construction services under Invitation for Bid 90241.
THAT this resolution shall become effective immediately.
