Subject:                      Resolutions approving a Mitigation Credit Purchase Agreement with Hammock Lake Mitigation Bank, LLC. and a Mitigation Credit Purchase and Deposit Agreement with Ecosystems Land Mitigation Bank Corporation d/b/a/ lake Louisa Land Trust for work at Leesburg International Airport

 

 

 

Staff Recommendation:

Staff recommends approval of both contracts for purchase of mitigation credits.

 

Analysis:

As part of the Runway 13/31 Extension Project, one thousand feet (1,000’) of runway with associated Taxiway A has been constructed on the east end of runway 13/31.  The new runway opened to air traffic in December.  To assure line of sight for air traffic controllers, several trees located north of Taxiway A had to be cut down.  The St. Johns River Water Management District (SJRWMD) advised that the removal of these trees impacted wetlands and must be mitigated.

 

As an addition to the Runway 13/31 Extension Project, it has been proposed to use excess fill dirt that is available due to the construction on the runway 31 end to extend the overrun safety area of runway 3.  This will allow three hundred feet (300’) of additional runway to be available for landing aircraft.  However, this construction will impact wetlands and must also be mitigated to satisfy requirements of SJRWMD and the US Army Corps of Engineers (USACOE).

 

The attached agreements between the City of Leesburg and Hammock Lake Mitigation Bank, LLC and Ecosystems Land Mitigation Bank Corporation d/b/a/ Lake Louisa Land Trust represent the purchase price for 1.93 fresh water herbaceous mitigation credits.  The Hammock Lake cost is $147,600 and the Lake Louisa cost is $14,000.00 for a total price of $161,600.00.  Grant funding from the FAA and FDOT will pay for 97.5% of this cost.  This purchase will satisfy the requirements of the SJRWMD and USACOE and allow this work to move forward.

 

Options:

1.  Approve the execution of the Mitigation Credit Purchase Agreement with Hammock Lake Mitigation Bank, LLC and the Mitigation Credit Purchase and Deposit Agreement with Ecosystems Land Mitigation Bank Corporation d/b/a/ Lake Louisa Land Trust; or

2.  Any other action that the City Commission may deem appropriate

Fiscal Impact:

The total cost for both mitigation agreements is $161,600.00.  The funding breakdown is as follows:

The grant agreements with FAA and FDOT were approved in the fall of 2008.  Available funding for mitigation has been rolled from fiscal year 2008-09 into the current year.
