Subject:                      Resolution authorizing  a non-exclusive Utility Easement and License with Lake County Water Authority.

Staff Recommendation:

Staff recommends approval of the resolution authorizing a non-exclusive utility easement and license  from Lake County Water Authority, pertaining to land located South of Okahumpka and East of State Road 33.

Analysis:

Lake County Water Authority is granting an underground, perpetual, non-exclusive Utility Easement to install a sanitary sewer force main and a reclaimed water pipeline.

Options:

1.  Adopt the Ordinance accepting the Utility Easement as presented; or,

2.  Such alternative action as the Commission may deem appropriate

a resolution of the city commission of the city of leesburg, florida, authorizing the mayor and city clerk to execute a non-exclusive utility easement and license between lake county water authority, as grantor, and the city of leesburg, as grantee; and providing an effective date.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute a Non-Exclusive Utility Easement and License between Lake County Water Authority and the City of Leesburg, Florida in the form attached as Exhibit “A” to this resolution.

 THAT this resolution shall become effective upon its passage and adoption according to law. 

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 25 day of January, 2010
