Subject:                      Resolution authorizing amendment one of an agreement with Lake County Water Authority to fund the Lake Lucerne Restoration Project under their Stormwater Grant Program  

Staff Recommendation:

Staff recommends approval of amendment number one to the agreement with Lake County Water Authority.

Analysis:

On January 26, 2009, the City Commission entered an agreement with Lake County Water Authority granting funding in an amount, not to exceed $45,490.00 in matching funds for the restoration portion of Lake Lucerne Stormwater Project, Resolution No. 8372.  Amendment number one extends the date for completion of that project by one hundred and twenty calendar days.  The delayed attainment of construction easements, required to complete the project, was the basis for the request of the extension.  With construction easements now in hand, Beasley Construction is awaiting the Notice of Award for the project. 

Options:

1.  Approve the agreement with Lake County Water Authority; or,

2.  Such alternative action as the Commission may deem appropriate

RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING AMENDMENT ONE TO AN AGREEMENT WITH LAKE COUNTY WATER AUTHORITY TO FUND THE LAKE LUCERNE RESTORATION PROJECT UNDER THEIR STORMWATER GRANT PROGRAM EXTENDING THE COMPLETION DATE BY ONE HUNDRED AND TWENTY DAYS; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute amendment number one to the agreement with Lake County Water Authority, whose address is 107 North Lake Avenue, Tavares, FL 32778, for Stormwater Grant Program Agreement to Fund the Lake Lucerne Restoration Project. 

 THAT this resolution shall become effective immediately.
