SUBJECT: Resolution adopting the 2010 Evaluation and Appraisal Report for the Comprehensive Plan
Staff Recommendation:
The Planning staff recommends adoption of the 2010 Evaluation and Appraisal Report and transmittal to the Department of Community Affairs.
Analysis:
Per Resolution No. 8592, passed January 11, 2010, the draft 2010 Evaluation and Appraisal Report (EAR) was transmitted to the Department of Community Affairs (DCA). Comments received from the Department have been addressed in this final version, which is now ready for adoption. Once the EAR has been found sufficient by DCA, the City will then begin the process of amending the Comprehensive Plan, according to the recommendations in the Report.
Options:
1. Approve the attached Resolution for adoption and transmittal of the 2010 Evaluation and Appraisal Report.
2. Other such action as the Commission may deem appropriate.

RESOLUTION NO._______________
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, ADOPTING THE 2010 EVALUATION AND APPRAISAL REPORT FOR THE LEESBURG COMPREHENSIVE PLAN; STATING THE INTENT TO AMEND THE COMPREHENSIVE PLAN BASED UPON RECOMMENDATIONS CONTAINED IN THE REPORT; AND APPROVING TRANSMITTAL OF THE REPORT TO THE DEPARTMENT OF COMMUNITY AFFAIRS IN ACCORDANCE WITH SECTION 163.3191, FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing process; and
WHEREAS, the Leesburg City Commission has adopted the Leesburg Comprehensive Plan, Ordinance Nos. 03-43, 03-44, 03-90, and 08-106; and
WHEREAS, Section 163.3191, Florida Statutes, directs local governments to periodically assess the success or failure of the adopted plan to adequately address changing conditions and state policies and rules; and
WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed amendments to ensure that the plan provides appropriate policy guidance for growth and development; and
WHEREAS, the Leesburg Planning Commission, acting as the designated Local Planning Agency, has reviewed the Evaluation and Appraisal Report, held an advertised public hearing on , November 19, 2009 provided for participation by the public in the process, and rendered its recommendations to the Leesburg City Commission; and
WHEREAS, the Leesburg City Commission has reviewed the 2010 Evaluation and Appraisal Report, held an advertised public hearing, and provided for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of Leesburg, Florida:
Section 1: The Leesburg City Commission does hereby adopt the 2010 Evaluation and Appraisal Report for the City of Leesburg Comprehensive Plan, attached here as Exhibit A.
Section 2: The Leesburg City Commission does hereby state its intention to amend the City of Leesburg Comprehensive Plan, Ordinance Nos. 03-43, 03-44, 03-90, and 08-106 in accordance with the recommendations contained in the 2010 Evaluation and Appraisal Report.
Section 3: The Leesburg City Commission does hereby approve transmittal of the 2010 Evaluation and Appraisal Report to the Department of Community Affairs for the purpose of a sufficiency review in accordance with Section 163.3191, Florida Statutes.
Section 4: This Resolution shall become effective immediately upon its passage.
Section 5: All Resolutions and parts of Resolutions in conflict herewith are repealed.
PASSED AND RESOLVED this 12th day of April 2010, by the City Commission of the City of Leesburg, Florida.
