Staff recommends approval of the ordinance changing the composition of the Personnel Committee to place the Finance Director as a member of the Committee and remove the City Clerk from the Committee.
From the inception of the Personnel Committee, the City Clerk/Finance Director (two different positions held by the same person) has served on the Committee. When the City Clerk/Finance Director position was separated in 2003, the City Clerk was placed on the Personnel Committee.
Because many of the decisions made by the Personnel Committee for recommendations to the City Commission involve funding, the Finance Director position is more appropriate as a member of the Personnel Committee.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING §2 – 101 OF THE CODE OF ORDINANCES PERTAINING TO THE COMPOSITION OF THE PERSONNEL COMMITTEE TO REMOVE THE CITY CLERK AS A MEMBER OF THAT COMMITTEE AND APPOINT THE CITY FINANCE DIRECTOR IN PLACE OF THE CITY CLERK; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA:
§2 – 101 of the Code of Ordinances of the City of Leesburg, Florida, is hereby amended to read as set forth below:
Sec. 2-101. Composition; appointment and term of members.
There shall be five (5) members of the personnel committee. Two (2) of the members shall be City Commissioners who are appointed by the City Commission at the organizational meeting each year. The other three (3) members of the committee are the City Manager, City Finance Director, and the Human Resources Director.
If any portion of this ordinance is declared invalid or unenforceable, then to the extent it is possible to do so without destroying the overall intent and effect of this ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of this ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable.
All ordinances or parts of ordinances which are in conflict with this ordinance are hereby repealed, to the extent necessary to alleviate the conflict, but shall continue in effect insofar as they are not in conflict herewith, unless repeal of the conflicting portion destroys the overall intent and effect of any of the conflicting ordinances, in which case those ordinances so affected shall be hereby repealed in their entirety.
This ordinance shall become effective upon its passage and adoption according to law.
