Subject:                      Ordinance accepting an underground electric distribution easement from Florida Power Corporation, doing business as Progress Energy Florida, Inc.

Staff Recommendation:

Staff recommends accepting the underground electric distribution easement executed in favor of the City of Leesburg by Florida Power Corporation, doing business as Progress Energy Florida, Inc. pertaining to land along Akron Drive.

Analysis:

Florida Power Corporation, doing business as Progress Energy Florida, Inc. is granting an underground electric distribution easement in favor of the City of Leesburg to construct, install, operate, maintain, inspect, repair and remove, in perpetuity, underground electric distribution lines comprised of two (2) parallel six-inch conduits each containing three (3) runs of 1000 mcm AL wire and related telecommunications wires, solely for the City of Leesburg’s use in connection with its distribution of electricity.

Options:

1.  Adopt the Ordinance accepting the underground electric distribution easement as presented; or,

2.  Such alternative action as the Commission may deem appropriate

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, ACCEPTING AN UNDERGROUND ELECTRIC DISTRIBUTION EASEMENT EXECUTED IN FAVOR OF THE CITY OF LEESBURG BY FLORIDA POWER CORPORATION, DOING BUSINESS AS PROGRESS ENERGY FLORIDA, INC., FOR THE PURPOSE OF GRANTING TO THE CITY OF LEESBURG AN EASEMENT FOR INSTALLATION AND MAINTENANCE OF UNDERGROUND ELECTRICAL LINES; AND PROVIDING AN EFFECTIVE DATE. 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

Section 1.

The City of Leesburg, Florida, does hereby accept an Underground Electric Distribution Easement executed in favor of the City of Leesburg by Florida Power Corporation, doing business as Progress Energy Florida, Inc., for the purpose of granting to the City of Leesburg an easement for the installation and maintenance of its underground electrical lines.

Section 2.   

If any portion of this ordinance is declared invalid or unenforceable, then to the extent it is possible to do so without destroying the overall intent and effect of this ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of this ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable. 

Section 3.

This ordinance shall become effective upon its passage and adoption according to law.
