SUBJECT:                  Large Scale Comprehensive Plan Amendment:  Musso-Spence

 

 

Staff Recommendation

The Planning staff recommends approval of the amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from County Urban to City Low Density Residential and Conservation.  The project site is larger than ten (10.0) acres and is, therefore, considered a Large Scale Comprehensive Plan Amendment under state statutes.  A first reading on this request was held by the City Commission on July 12, 2010.  The amendment was subsequently transmitted to DCA for review and no substantive comments were received. 

 

Analysis

The project site is approximately 20 acres. The general location is south of Park Holland Road, east of Picciola Road.  The project site is currently undeveloped and the surrounding Future Land Use Map designations are:                                            

North –            City High Density and Estate 

South –            City Conservation       

East –              County Urban 

West –                         City High Density and General Commercial

           

The Land Use for the property is currently County Urban. The property is currently zoned PUD with residential uses, which is consistent with the proposed Future Land Use designation.

 

The existing land uses surrounding the property are:

                                    North –            Residential

                                    South –            undeveloped

                                    East –                          undeveloped

                                    West –             undeveloped

 

 


Options:

 

1.      To approve or disapprove the City Future Land Use Map amendment designating the site as City Low Density Residential and Conservation.

 

2.      Such alternative action as the Commission may deem appropriate. 

 

Fiscal Impact:

This large-scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 20 ACRES AND GENERALLY LOCATED SOUTH OF PARK HOLLAND ROAD, EAST OF PICCIOLA ROAD, LYING IN SECTION 14, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN TO CITY LOW DENSITY RESIDENTIAL AND CONSERVATION, REPEALING CONFLICTING ORDINANCES, PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE (MUSSO-SPENCE).

 

WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and has made recommendations to the City Commission for amendment of the Plan; and

 

WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public; 

 

NOW, THEREFORE,

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1

 

The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:

 

The Future Land Use Map is amended by changing the designation of an approximate 20 acre parcel of land generally located south of Park Holland Road, east of Picciola Road, lying in Section 14, Township 19 South, Range 24 East, Lake County, Florida, legally described as:

 

From the Northwest corner of Government Lot 2, in Section 14, Township 19 South, range 24 East, run South along the West line of said Section for 20 feet; run thence East parallel to the North line of said Government Lot 2 for 381.0 feet for the Point of Beginning.  From said Point of Beginning run South parallel to West line of said Section for 251.5 feet, thence turn an angle to the West of 89°46’50” and run 381.0 feet to the West line of said Section, run thence South along said West Section line for 1068 feet, more or less, to the South line of Government Lot 2, run thence East along said South line for 775 feet, run thence North, parallel to West line of said Section for 1320 feet, more or less, to a point that is 374 feet East of the Point of Beginning.  Run thence West 374 feet to the Point of Beginning.  Less the East 160 feet of the West 705 feet of the North 220 feet of said Government Lot 2.

 

And

 

The East 324 feet of the West 755 feet of the North 251.5 feet of the Southwest ¼ of the Northwest ¼, Less the East 160 feet of the West 705 feet of the North 251.5 feet.

The South 72.5 feet of the East 160 feet of the West 705 feet of the North 292.5 feet of Government Lot 2, in Section 14, Township 19 South, Range 24 East, Lake County, Florida.

Section 2.   

 

All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.

 

 

Section 3.

 

If any portion of this ordinance is found to be void by the courts, then to the extent it is possible to do so without destroying or materially impairing the overall intent and effectiveness of this ordinance, the portion found to be void shall be severed from this ordinance and the remainder shall continue in force and effect as if enacted without inclusion of the portion found to be void.

 

Section 4. 

 

This ordinance shall become effective upon its passage and adoption, according to law.
