SUBJECT:                  Large Scale Comprehensive Plan Amendment:  PEAR Park

 

 

Staff Recommendation

The Planning staff recommends approval of the proposed amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from High Density Residential and General Commercial to Institutional and Conservation.  The project site is larger than ten (10.0) acres and is, therefore, considered a Large Scale Comprehensive Plan Amendment under state statutes.  A first reading on this request was held by the City Commission on July 12, 2010.  The amendment was subsequently transmitted to DCA for review.  As part of this review process, a text amendment to the Comprehensive Plan for a site specific Policy was developed, since the proposed development is substantially less than what is allowed under the proposed Future Land Use classification.  The text amendment is included in the attached ordinance for adoption.

 

Analysis

The project site is approximately 50 acres. The general location is north of University Avenue and west of US Hwy 27.  The project site is currently undeveloped and the surrounding Future Land Use Map designations are:       

North –            City Estate and City Low Density

South –            County Urban Expansion                   

East –              County Urban Expansion       

West –                         County Urban Expansion

 

The Land Use for the property is currently City High Density Residential and City General Commercial. The property is currently zoned Public, which is consistent with the proposed Future Land Use designation.

 

The existing land uses surrounding the property are:

North –            Residential      

South –            Residential

East –              Residential      

                                    West –              Undeveloped

 


Options:

 

1.      To approve or disapprove the City Future Land Use Map amendment designating the site as Institutional and Conservation and site specific Policy text amendment.

 

1.      Such alternative action as the Commission may deem appropriate. 

 

Fiscal Impact:

This large-scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 50 ACRES AND GENERALLY LOCATED NORTH OF UNIVERSITY AVENUE AND WEST OF US HWY 27, LYING IN SECTION 24, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM HIGH DENSITY RESIDENTIAL AND GENERAL COMMERCIAL TO INSTITUTIONAL AND CONSERVATION,  AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN BY ADDING POLICY 1.6.13 TO PROVIDE SITE SPECIFIC DEVELOPMENT STANDARDS, REPEALING CONFLICTING ORDINANCES, PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE (PEAR PARK).

 

WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and has made recommendations to the City Commission for amendment of the Plan; and

 

WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public; and

 

WHEREAS, the “PEAR Park” Large Scale Comprehensive Plan Amendment has been reviewed by the Department of Community Affairs; and

 

WHEREAS, as part of this review, a site specific Policy was developed for addition to the Future Land Use Element of the Comprehensive Plan, since the proposed development is substantially less than what is allowed under the proposed Future Land Use classification;

 

 

NOW, THEREFORE,

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1

 

The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:

 

The Future Land Use Map is amended by changing the designation of an approximate 50 acre parcel of land generally located north of University Avenue and west of US Hwy 27, lying in Section 24, Township 20 South, Range 24 East, Lake County, Florida, legally described as:

Section 2.   

 

The Future Land Use Element of the Comprehensive Plan is hereby amended with the addition of the following Policy:

 

Policy 1.6.13

 

The City of Leesburg will enforce development standards on the “PEAR Park” property, for which a comprehensive plan amendment to City Institutional (38 + acres) and Conservation (12 + acres) was adopted by Ordinance xx-xx, in order to ensure coordination with public facilities, including transportation demand.  Development shall meet the applicable goals, objectives and policies of the Comprehensive Plan; however, the land use and development potential made available by the FLUM Amendment is hereby limited as follows:

 

·         The Amendment Parcel shall be developed as a park and no other institutional land uses shall be allowed.

·         Development is required to be served by central potable water and central sanitary sewer facilities.

 

Section 3. 

 

All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.

 

Section 4.

 

If any portion of this ordinance is found to be void by the courts, then to the extent it is possible to do so without destroying or materially impairing the overall intent and effectiveness of this ordinance, the portion found to be void shall be severed from this ordinance and the remainder shall continue in force and effect as if enacted without inclusion of the portion found to be void.

 

Section 5. 

 

This ordinance shall become effective upon its passage and adoption, according to law.
