SUBJECT:                  Ordinance for City of Leesburg East Annexation

 

 

 

Staff Recommendation

The Planning staff recommends approval of the proposed Leesburg East Annexation.

 

Analysis

The project site is approximately 106 acres. The property is generally located along US Highway 441, from east of Fern Drive to east of the intersection with CR 44. This area consists of 46 parcels of land and 27 property owners. The boundaries were chosen to be consistent with the City’s utility service area and the City’s JPA Planning Area so as to meet the provisions in Florida Statutes for a compact and contiguous annexation. This is a part of a continued effort to annex infill areas along the US Hwy 441 corridor, since the annexation of Lake-Sumter Community College, Lake Square Mall, and surrounding properties in 2002.

 

Since no qualified electors reside within the annexation area, no referendum is required.  Chapter 171.0413(6), Florida Statutes, provides for the City to initiate annexations with the consent of at least 50% of the property owners. The consenting property owners plus the properties covered by the recorded Covenants to Annex represent 52% of the total 106 acres.

 

The entire annexation area is within unincorporated Lake County, Florida, as shown on the attached General Location Map. Currently, the existing land uses include Undeveloped, Commercial, Municipal, Conservation, Utilities, and Mobile Homes. The proposed Future Land Use designation for the subject property is City General Commercial, Institutional, and Conservation.  The amendment to the Future Land Use Map will be processed next year with the Leesburg Comprehensive Plan Update and EAR-based Amendments.

 

Also on the agenda for this meeting is a rezoning application for this property, from County C-2 (Community Commercial), RMRP (Mobile Home Rental Park District), RP (Residential Professional), CP (Planned Commercial District), LM (Light Industrial District), and R-1 (Rural Residential)to City C-3 (Highway Commercial) and P (Public), which is recommended for approval by the staff and Planning Commission. The majority of the properties are proposed for rezoning to City C-3 (Highway Commercial).  Other government and utility owned properties are proposed for rezoning to P (Public).  The proposed zoning districts of City C-3 (Highway Commercial) and P (Public) are compatible with the adjacent and nearby properties in the area and with the proposed future land use designations of City General Commercial, Institutional, and Conservation.

                                    

City water and wastewater utilities are available in the area. The developer is responsible for all cost and construction to make the necessary extension and hook-ups to City utilities in accordance with City requirements. Police and fire services are presently provided in this area and impacts on the provision of these services are estimated to be minimal.

 

Options:

1.         Approve the Leesburg East Annexation

2.         Other such action as the Commission may deem appropriate.

 

Fiscal Impact:

There is a positive fiscal impact to the City by annexing these properties.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, ANNEXING CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY 106 ACRES AND BEING GENERALLY LOCATED ALONG US HIGHWAY 441, FROM EAST OF FERN DRIVE TO EAST OF THE INTERSECTION WITH CR 44, LYING IN SECTIONS 19 AND 20, TOWNSHIP 19, RANGE 25 EAST, LAKE COUNTY, FLORIDA, WHICH IS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF LEESBURG, FLORIDA, PROVIDING THAT SAID PROPERTY SO ANNEXED SHALL BE LIABLE FOR ITS PROPORTIONATE SHARE OF THE EXISTING AND FUTURE INDEBTEDNESS OF SAID CITY; PROVIDING THAT SUCH ANNEXED PROPERTY SHALL BE SUBJECT TO ALL LAWS AND ORDINANCES OF SAID CITY AS IF ALL SUCH TERRITORY HAD BEEN A PART OF THE CITY OF LEESBURG AT THE TIME OF PASSAGE AND APPROVAL OF SAID LAWS AND ORDINANCES; PROVIDING THAT SUCH ANNEXED TERRITORY SHALL BE PLACED IN CITY COMMISSION DISTRICT 1; AND PROVIDING AN EFFECTIVE DATE (EAST ANNEXATION).

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1

 

Based upon the “Annexation Report on Leesburg East Annexation Area (Property Along US Highway 441 From East of Fern Drive to East of Intersection with CR 44)” dated October 2010, as previously transmitted by the Leesburg City Commission to the Lake County Commission in accordance with the requirements of Chapter 171.042, Florida Statutes, and based further on written consents filed with the City of Leesburg by the owners of more than 50% of the total land area affected by this Ordinance, requesting annexation into the City of Leesburg, the hereinafter described property is hereby annexed into the City of Leesburg, and made a part of the city limits of the City of Leesburg, Florida.  The subject property lying and situated in Lake County, Florida, is more particularly described as:

Section 2.   

 

All of the property, real and personal, within said annexed territory, described in Section 1 above, as provided by this ordinance, and the inhabitants thereof, shall be subject to the government, jurisdiction, powers, franchises, duties, and privileges of the City of Leesburg, Florida, and the said annexed property shall be  liable, proportionately, for all of the present outstanding and existing, as well as future, indebtedness of the City of Leesburg, Florida; that all of the ordinances of the City of Leesburg, and all laws heretofore passed by the Legislature of the State of Florida relating to and which now or hereafter constitute its Charter, shall apply to and have the same force and effect on such annexed territory as if all such annexed territory had been a part of the City of Leesburg, Florida, at the time of the passage and approval of said laws and ordinances. The property annexed hereby is assigned to City Commission District 1.

 

Section 3.   

 

This ordinance shall become effective immediately upon approval at second reading.
