SUBJECT: Resolution Authorizing Execution of a Quit Claim Deed for approximately .11 acre of City Property as a Donation to the Lake Sumter Children’s Advocacy Center, Inc.

Staff Recommendation
Staff recommends approval of the request from the Lake Sumter Children’s Advocacy Center, Inc.
for the donation of approximately .11 acre of City surplus, unneeded property on the site of the Children’s Advocacy Center. Applicant will be responsible for all cost associated with this conveyance.
Analysis
The attached letter from the Lake Sumter Children’s Advocacy Center, Inc.’s attorney, M. Meredith Kriste, requests the City donate the City property that is currently part of the paved parking lot for the Children’s Advocacy Center. The property will continue to be used for parking. The City has no need for the property other than for utilities, which will be accomplished by a utility easement. This property does not serve the recreational trails system and is not in the master plan for the trail network. There is currently a rezoning applicant for the Children’s Advocacy Center under consideration by the City Commission on this agenda that requires resolution of this issue.
Options
1. Approve the Resolution for the Quit Claim Deed for Lake Sumter Children’s Advocacy Center, Inc.
2. Other such action as the Commission may deem appropriate.

There is no fiscal impact to the City with this action.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A QUIT CLAIM DEED FOR APPROXIMATELY .11 ACRE OF CITY PROPERTY LOCATED ON THE EAST SIDE OF S. CANAL STREET ON THE SOUTH SIDE OF PINE STREET AS A DONATION TO THE LAKE SUMTER CHILDREN’S ADVOCACY CENTER, INC AS PER ATTACHED EXHIBIT A; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute a Quit Claim Deed for City property donation to the Lake Sumter Children’s Advocacy Center, Inc. whose address is 300 S. Canal Street, Leesburg, Florida 34748, for City property located on the east side of S. Canal Street on the south side of Pine Street as per attached Exhibit A. Applicant will be responsible for all cost associated with this conveyance.
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 13th day of December 2010.
