Subject: Resolution  authorizing Harmon Bynum to serve as Designated Representative/Responsible Corporate Office for the City of Leesburg for the purpose of complying with EPA rule 40 CFR Part 98  

Staff Recommendation:

Staff recommends approval of Harmon Bynum as the Designated Representative/Responsible Corporate Officer for the purpose of complying with EPA rule 40 CFR Part 98

Analysis:

On November 8, 2010, EPA Administrator, Lisa Jackson signed a rule that finalized reporting requirements for the petroleum and natural gas industry under 40 CFR Part 98, the regulatory framework for the Greenhouse Gas (GHG) Reporting Program. This final rule, in part, requires Local Distribution Companies (LDC) that deliver more than 460,000 MCF annually to report methane (CH₄) and CO₂ emissions. Appointment of a Designated Representative/Responsible Corporate Officer is required for reporting purposes. Commission action is required for this appointment because the rule requires that the Designated Representative/Responsible Corporate Officer be authorized to bind the city in matters within the scope of the rule.

1.  Approve Harmon Bynum as the Designated Representative/Responsible Corporate Officer

2.  Such alternative action as the Commission may deem appropriate

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING HARMON BYNUM TO SERVE AS DESIGNATED REPRESENTATIVE/ RESPONSIBLE CORPORATE OFFICER FOR THE CITY OF LEESBURG FOR THE PURPOSE OF COMPLYING WITH EPA RULE 40 CFR PART 98 AND PROVIDING AN EFFECTIVE DATE. 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the City Commission hereby appoints Harmon Bynum as the Designated Representative/Responsible Corporate Officer for the City of Leesburg, Florida for the purpose of reporting green house gas emissions as required by EPA rule 40 CFR Part 98 to the fullest extent of the Rule, but not in excess of such requirement, the Designated Representative/Responsible Corporate Officer is vested with the power and authority to take actions which are binding on the City when acting within the scope of his responsibilities under the Rule.

 THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 10^th day of January, 2011.
