Subject:                      Resolution authorizing execution of a Subordination of Utility Interests with the State of Florida Department of Transportation for the Widening of US Hwy. 441 at Perkins Street to SR 44

 

 

Staff Recommendation:

Staff recommends approval of a Subordination of city utility interests in favor of the State of Florida Department of Transportation (FDOT) for facilitating the relocation of city utilities within four land parcels for the widening of US Hwy. 441 from Perkins Street to SR 44.

 

Analysis:

The City of Leesburg has been approached by the FDOT requesting a subordination of city utility interests of four (4) parcels of land, 109.2, 131.3, 132.2R, and 807.3 that will impact the widening of US Hwy. 441 from Perkins Street to SR 44.  The terms allow the city utilities to remain in place and if FDOT improvements require the relocation or alteration of city utilities, FDOT will assume the financial responsibility, including obtaining any necessary easements for relocations.

 

Options:

1.  Approve the execution of a subordination of city utility interests with FDOT; or

2.  Such alternative action as the Commission may deem appropriate

 

Fiscal Impact: 

There will be no fiscal impact to the City.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A SUBORDINATION OF UTILITY INTERESTS WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE WIDENING OF US HWY. 441 PERKINS STREET TO SR 44; AND PROVIDING AN EFFECTIVE DATE.

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

            THAT the Mayor and City Clerk are hereby authorized to execute a Subordination of City Utility Interests Agreement for Parcel No. 109.2, 131.3, 132.2R, and 807.3 with the State of Florida Department of Transportation, whose address is 719 South Woodland Boulevard, Deland, Florida 32720, for the purpose of facilitating the relocation of city utilities for the widening of US Hwy. 441 from Perkins Street to SR 44.

 

             THAT this resolution shall become effective immediately.

 

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 10th day of  January 2011.
