Subject: Resolution authorizing release of the automatic, statutory reservation of petroleum and mineral rights under 270.11(1), Fl. Stat. (2006) for property at 2125 Anoka Way, Leesburg, Florida.
Staff Recommendation:
Staff recommends approval of release of the automatic, statutory reservation of petroleum, and mineral rights under 270.11(1), Fl. Stat. (2006) for property at 2125 Anoka Way, Leesburg, Florida.
Analysis:
The subject property is currently owned by the City of Leesburg. The City has a contract for sale and purchase of the subject property with Delon Manns, a first-time homebuyer. The release of the automatic, statutory reservation of petroleum and mineral rights under 270.11(1), Fl. Stat. (2006) will assist in executing the contract for sale and purchase of the property.
The property is part of the City’s collaborative effort with Lake County Government’s Neighborhood Stabilization Program. This program is designed to fund the acquisition and rehabilitation of foreclosed and abandoned properties in order to market for purchase by first-time homebuyers. The program is geared toward stabilizing the housing market and providing quality housing.
Options:
1. Approve the release of the automatic, statutory reservation of petroleum and mineral rights under 270.11(1), Fl. Stat. (2006) for property located at 2125 Anoka Way, Leesburg, Fl. or;
2. Such alternative action as the City Commission may deem appropriate.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE RELEASE OF THE AUTOMATIC, STATUTORY RESERVATION OF PETROLEUM AND MINERAL RIGHTS UNDER 270.11 (1), FLA. STAT. (2006) ON PROPERTY LOCATED AT 2125 ANOKA, LEESBURG, FLORIDA, LEGALLY DESCRIBED AS LOT 46, OVERLAKE AT LAKE GRIFFIN, AS RECORDED IN PLAT BOOK 54, PAGE 20, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT, based on the petition of the prospective purchaser of the property and the prospective purchase money lender, the Mayor and City Clerk are authorized and directed to release the automatic, statutory reservation of petroleum and mineral rights under 270.11(1), Fla. Stat. (2010), on the property located at 2125 Anoka Way, Leesburg, Florida, legally described as Lot 46, Overlook at Lake Griffin, as recorded in Plat Book 54, Page 20, Public Records of Lake County, Florida, pursuant to the contract for sale and purchase between the City of Leesburg and Delon Manns. The release of the mineral and petroleum interests is justified by the fact the property is a platted, single family residential lot improved with a home, such that exploration for an extraction of minerals or petroleum would be impracticable due to the small size of the property.
THIS RESOLUTION shall become effective upon its passage and adoption according to law.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the _11th____ day of __April_______ 2011.
