Staff Recommendation:
The
Building staff recommends approval of the referenced amendment to the Code of
Ordinances amending Chapter 7, Section 7–16.
Analysis:
The
2010 edition of the Florida Building Code became effective March 15, 2012. The
proposed ordinance will adopt the 2010 version of the Florida Building Code, as
the building codes for the City of Leesburg, Florida, by reference, and will incorporate
them into the Code. This amendment will update the current 2007 code as
required by state statue. The revised building code was mandated by the Florida
Legislature and the code went into effect automatically.
Options:
1. Approve
the recommended amendment to the Code of Ordinances Chapter 7, Section7–16.
2. Other such action as the Commission may
deem appropriate.
Fiscal Impact:
There
should be no fiscal impact to the City with these proposed changes.

ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING §7 – 16 OF THE CODE OF
ORDINANCES, PERTAINING TO THE BUILDING CODE, ADOPTING THE 2010 FLORIDA BUILDING
CODE EFFECTIVE MARCH 15, 2012, INCLUDING THE BUILDING CODE, BUILDING CODE –
RESIDENTIAL; BUILDING CODE – ACCESSIBILITY; BUILDING CODE – ENERGY; AND
BUILDING CODE – EXISTING; ADOPTING AND INCORPORATING A WIND SPEED MAP
SPECIFYING THE WIND ZONES WITHIN THE CITY; AMENDING §1 – 151 OF THE CODE OF
ORDINANCES TO ADOPT THE FLORIDA BUILDING CODE – MECHANICAL; AMENDING §7 – 116
OF THE CODE OF ORDINANCES TO ADOPT THE BUILDING CODE – PLUMBING; AMENDING §7 –
36 OF THE CODE OF ORDINANCES TO ADOPT THE 2008 NATIONAL ELECTRICAL CODE;
AMENDING §7 – 136 OF THE CODE OF ORDINANCES TO ADOPT THE 2009 INTERNATIONAL
FUEL GAS CODE WITH FLORIDA SUPPLEMENTS; ESTABLISHING APPEAL PROCEDURES FOR EACH
CODE ADOPTED IN THIS ORDINANCE; REPEALING CONFLICTING ORDINANCES; PROVIDING
SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,
effective as of March 15, 2012, the State of Florida has enacted new codes
governing various aspects of the building trades, including the Building Code,
Building Code – Mechanical, Building Code – Plumbing, Building Code –
Residential, Building Code – Accessibility, Building Code – Energy, Building
Code – Existing, Fire Prevention Code, Fuel Gas Code, and Electrical Code, and
WHEREAS,
it is in the best
interests of the citizens of the City of Leesburg and the protection of the
public health, safety and welfare for the City of Leesburg to adopt and enforce
the latest versions of these various codes,
NOW THEREFORE, BE IT
ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA:
SECTION I.
§7 – 16 of the
Code of Ordinances of the City of Leesburg, Florida, is hereby amended in its
entirety and shall, after the effective date of this Ordinance, read as set
forth below:
Sec. 7 – 16. Building Code Adopted.
The 2010 version of the Florida Building
Code, effective as of March 15, 2012, is adopted as the building code for the
City of Leesburg, Florida, comprised more specifically of the Florida Building
Code, Building Code – Residential, Building Code – Accessibility, Building Code
– Energy, and Building Code – Existing, each of which is adopted by reference,
and incorporated into this Code as fully as if set out in full herein. Appeals
from the application or interpretation of this Code by the Building Official or
other City staff, and requests for variances, shall be presented to the Board
of Adjustments and Appeals utilizing the procedures in §§7 – 3, 7 – 4 and 7 – 5
of the Code of Ordinances. For purposes of the Building Code the City Limits of
the City of Leesburg are within the following listed Wind Speed Risk Categories
and as shown on Figure 1609B attached:
A.
For
Risk Category I Buildings: Vult 125mph
B.
Foe
Risk Category II Building: Vult 135mph
C.
For
Risk Category III and IV Buildings:
(1)
Vult
139 mph for all lands lying northerly of a line being; 1 mile south of the north line of Township 20 south; and
lying in Lake County, Florida and; with the Municipal Limits of Leesburg,
Florida .
(2)
Vult
140 mph for all lands lying southerly of a line being; 1 mile south of the
north line of Township 20 south; and lying in Lake County, Florida and; within
the Municipal Limits of Leesburg, Florida
SECTION II
§7 – 151 of the
Code of Ordinances of the City of Leesburg, Florida, is hereby amended in its
entirety and shall, after the effective date of this Ordinance, read as set
forth below:
Sec. 7 – 151. Mechanical Code Adopted.
The 2010 version of the Florida Building
Code – Mechanical is hereby adopted by reference and incorporated in this
section as though set out in full. Appeals from the application or
interpretation of this Code by the Building Official or other City staff, and
requests for variances, shall be presented to the Board of Adjustments and
Appeals utilizing the procedures in §§7 – 3, 7 – 4 and 7 – 5 of the Code of
Ordinances.
SECTION III.
Sec. 7 – 116. Plumbing Code Adopted.
The 2010 version of the Florida Building
Code – Plumbing is hereby adopted by reference and incorporated into this
section as though set out in full. Appeals from the application or
interpretation of this Code by the Building Official or other City staff, and
requests for variances, shall be presented to the Board of Adjustments and
Appeals utilizing the procedures in §§7 – 3, 7 – 4 and 7 – 5 of the Code of
Ordinances.
SECTION IV.
Sec. 7 – 36. National Electrical Code Adopted.
The 2008 version of the National
Electrical Code is hereby adopted by reference and incorporated into this
section as though set out in full. Appeals from the application or
interpretation of this Code by the Building Official or other City staff, and
requests for variances, shall be presented to the Board of Adjustments and
Appeals utilizing the procedures in §§7 – 3, 7 – 4 and 7 – 5 of the Code of
Ordinances.
SECTION V.
Sec. 10 – 1. Fire Prevention Code
Adopted.
The 2010 Florida Fire Prevention Code is
hereby adopted by reference and incorporated into this section as though set
out in full. Appeals from the application or interpretation of this Code by the
Building Official or other City staff, and requests for variances, shall be
presented to the Board of Adjustments and Appeals utilizing the procedures in
§§7 – 3, 7 – 4 and 7 – 5 of the Code of Ordinances.
SECTION VI.
Sec.
7 – 136. Natural Gas Code Adopted.
The 2009 International Fuel
Gas Code, with Florida Supplements, is hereby adopted by reference and
incorporated into this section as though set out in full. Appeals from the
application or interpretation of this Code by the Building Official or other
City staff, and requests for variances, shall be presented to the Board of
Adjustments and Appeals utilizing the procedures in §§7 – 3, 7 – 4 and 7 – 5 of
the Code of Ordinances.
SECTION VII.
If
any portion of this ordinance is declared invalid or unenforceable, then to the
extent it is possible to do so without destroying the overall intent and effect
of this ordinance, the portion deemed invalid or unenforceable shall be severed
herefrom and the remainder of this ordinance shall continue in full force and
effect as if it were enacted without including the portion found to be invalid
or unenforceable.
SECTION VIII.
All ordinances or parts of ordinances
which are in conflict with this ordinance are hereby repealed, to the extent
necessary to alleviate the conflict, but shall continue in effect insofar as
they are not in conflict herewith, unless repeal of the conflicting portion
destroys the overall intent and effect of any of the conflicting ordinances, in which case
those ordinances so affected shall be hereby repealed in their entirety.
SECTION IX.
This ordinance is effective as of 12:00 a.m. on March 15,
2012.
