Staff Recommendation:
The
Planning staff and the Planning Commission recommend approval of the proposed
rezoning for the subject property from City R-2 (Medium Density
Residential) to City RP (Residential Professional).
Analysis:
The
project site is approximately .38 of an acre.
The property is generally located on the south side of South Street, east
of Lucas Street and south of Hickory Drive as shown on the attached General
Location Map. The present zoning for this property is City R-2 (Medium Density
Residential). The current use of the property is a vacant lot and the proposed
use is for over flow parking. The surrounding zoning designations are City R-1
(Low Density Residential), City R-2 (Medium Density Residential), and C-3
(Highway Commercial). The surrounding Future Land Use Map designations are City
Low Density Residential and to the west High Density Residential. The existing Land Use designation for the
subject property is City Low Density Residential.
The proposed zoning district of City RP
(Residential Professional) is compatible with the adjacent and nearby
properties in the area and with a future land use designation of City Low Density Residential. This is an
area of transition from older residential uses to professional uses and the
proposed zoning would provide for transition to the adjacent residential uses. This
is an area that will receive the new Transition Land Use classification with
the adoption of the updated Comprehensive Plan by the end of the year. This request does not appear to create a
detriment to the surrounding properties.
The existing land uses surrounding the
property are single family residential and multi-family residential.
The property currently has City
utilities available.
By
a vote of 4 to 0 on June 21, 2012,
the Planning Commission voted to recommend approval.
Options:
1. Approve the proposed rezoning to City RP (Residential
Professional) thereby allowing consistent zoning and development standards for
this area.
2. Other
such action as the Commission may deem appropriate.
Fiscal Impact:
There
is a positive fiscal impact to the City through the further development of this
property.

AN ORDINANCE OF THE
BE IT ENACTED
BY THE PEOPLE OF THE CITY OF
Section 1.
Based upon the petition of Lake County Educational Association, the
petitioner of the property hereinafter described, which petition has heretofore
been approved by the City Commission of the City of Leesburg Florida, pursuant
to the provisions of the Laws of Florida, the said property located in Lake
County, Florida, is hereby rezoned from City R-2 (Medium Density Residential) to RP (Residential Professional), to-wit:

The North 90.0 feet of the West 185.0 feet of that part of Lot 2, Block
“B”, according to
the plat of W.C. Wilkins Subdivision, filed January 4
1923, and recorded
in Plat Book 5, page 11, of the public records of Lake
County, Florida, lying South of the South right-of-way line of South
Street
as it now exists.
