Subject: Resolution authorizing a Mutual Assistance Agreement with Florida Cable, Inc. for the exchange of network assets and services.
Staff recommends approval of a resolution authorizing a Mutual Assistance Agreement with Florida Cable, Inc. for the exchange of network assets and services.
Florida Cable provides video, voice and data services to residential customers in various parts of Lake County (as well as other nearby counties). The company provides those services mostly over its own network, but also leases some circuits from other parties such as Leesburg’s Communications Utility.
Florida Cable wishes to use certain portions of Leesburg’s fiber optic network to transport its services to various parts of Lake County.
Leesburg’s Communications Utility wishes to use certain portions of Florida Cable’s network to (i) provide services to some of the more remote Lake County Schools sites and (ii) effectively supplement the Leesburg fiber optic network in several strategic areas.
Each party (Florida Cable and Leesburg’s Communications Utility) owns certain vehicles and equipment and employs personnel with specific skills, all of which are useful in maintaining and repairing fiber optic networks. Each party wishes to enhance its own ability to respond to emergency repair requirements by arranging to have access to the other party’s vehicles, equipment and personnel during such emergency situations.
This agreement allows each party to gain the use of specified portions of the other’s network and gives each party the right to call upon the other for support with vehicles, equipment and personnel during emergency situations.
Additionally, this agreement allows the Leesburg Communications Utility to connect to Astatula Elementary, Lake Hills Elementary and Seminole Springs Elementary utilizing Florida Cable assets. Florida Cable also owns conduit that is attached to the State Route 19 bridge crossing the northern end of Little Lake Harris. As a part of this agreement, the City’s Communications Utility will receive the right to place a fiber optic cable in that conduit. Doing so will save the Utility the cost of deploying its own conduit across that bridge which is a strategic part of a redundant route between the greater Leesburg and Tavares areas where the Utility has many customers.

The Communications Utility has included the estimated construction costs for the school routes in its estimated project costs for its Lake County Schools project.
The Communications Utility will likely earn some small amount of miscellaneous jobbing revenue when it provides vehicles, equipment and personnel to Florida Cable during emergency repair situations.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A MUTUAL ASSISTANCE AGREEMENT WITH FLORIDA CABLE, INC. FOR THE EXCHANGE OF NETWORK ASSETS AND SUPPORT SERVICES; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute a Mutual Assistance Agreement with FLORIDA CABLE, INC., whose address is 23505 SR 40, ASTOR, FL 32102, for the exchange of network assets and support services.
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the twenty-seventh day of August 2012.
