Subject:                      Cable Easement to CenturyLink on city’s north spraysite property at CR 470

 

 


Staff Recommendation:

Staff recommends approval of the Cable Easement.

 

Analysis:

Embarq Florida, Inc. d/b/a as CenturyLink has requested a cable easement to access the communications tower located on the city’s north spraysite property at CR 470.  Previous easements have generally followed an access road which threads through the middle of the property.  This may interfere with future uses of the property. 

 

Therefore, this non-exclusive easement follows the western edge of the property line, adjacent to the turnpike.  This location will remain clear of any future use or redevelopment of the spraysite property.  There are no adverse impacts associated with the easement.

 

Options:

1.  Authorize the Mayor and City Clerk to execute the attached easement; or,

2.  Such alternative action as the Commission may deem appropriate

 

Fiscal Impact: 

There is no direct fiscal impact to the city.  The easement may result in future additions to the communications tower by third parties and lease payments to the city for any facilities associated with such additions.  These are unknown at this time.

RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CABLE EASEMENT TO EMBARQ FLORIDA, INC. D/B/A AS CENTURY LINK FOR ACCESS TO THE COMMUNICATIONS TOWER ON THE CITY'S NORTH SPRAYSITE PROPERTY AT CR 470; AND PROVIDING AN EFFECTIVE DATE.; and providing an effective date.

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

            THAT the Mayor and City Clerk are hereby authorized to execute a non-exclusive cable easement with City as Grantor and with Embarq Florida, Inc. d/b/a CenturyLink whose address is 100 CenturyLink Drive, Monroe, LA 71203 as Grantee.

 

             THAT this resolution shall become effective immediately.
