Staff Recommendation:
Staff and the Planning Commission request
the City Commission approve an ordinance authorizing for the transmittal to FDEO
Division of Community Planning and Development of the
Comprehensive Plan 2035 update and request an expedited State review
pursuant to Section 163.3184(3), F.S.
Analysis:
Per Chapter 163 Florida Statutes, the
City of Leesburg is required to create, adopt, and maintain a Comprehensive
Plan that addresses where residential and non-residential uses are located in
their jurisdiction. The City of
Leesburg on September 22, 2003, by Ordinance Number 03-90, adopted a
Comprehensive Plan which incorporated a Future Land Use Element setting forth
the goals, objectives, and policies to guide and direct future development and
growth to 2020. The City Commission, in order to provide for the health,
safety, and welfare of the citizens of the City of Leesburg, needs to adopt a
new revised Comprehensive Plan as required by state statute to govern land use
and development through the year 2035. The recommended changes are consistent
with Section 163 Florida Statutes and the current adopted City’s 2020 Comprehensive Plan, and incorporate
the needed revisions to the south Leesburg area. An Executive Summary and Future Land Use map are attached for
additional information.
Options:
1. Approve an ordinance for transmittal of the
Comprehensive Plan 2035 update to the FDEO and requesting an expedited State
review.
2. Such
other action as the Commission may deem appropriate.

Comprehensive Plan 2035
Executive Summary
The Comprehensive Plan has been updated to
2035 to reflect changes in population (based on the 2010 Census), changes in
Florida Statutes and associated comprehensive plan requirements, and updated
population projections to 2035. In
addition to updated data and analysis in all elements, the main changes can be
summarized as follows:
The Future Land Use Element data &
analysis has been updated to include current population data and
projections. New Future Land Use
categories have been added to promote mixed use development, industrial and
technology parks, and the transition of older residential areas into low
intensity business uses. The map series
has been updated and a revised Future Land Use Map incorporates many of the
projects approved in southwest Leesburg since 2003 and also reflects the new
category designations.
Public hearings
regarding the proposed amendments will be held by the Local Planning Agency –
LPA (City of Leesburg Planning Commission) on July 19, 2012 at 4:30 p.m.
followed by a transmittal public hearing on the ordinance by the City
Commission on August 13, 2012, at 5:30 p.m. All hearings will be in the City
Commission Chambers, 3rd floor, City Hall, 501 West Meadow.
The purpose of the
hearings is to receive public input on the comprehensive plan update and Future
Land Use Map changes prior to final adoption.
A final adoption
hearing will be scheduled after receipt of comments from the Florida Department
of Economic Opportunity (FDEO) review.

The proposed
amendments and all supporting documents may be inspected by the public at

AN ORDINANCE OF THE
CITY OF LEESBURG, FLORIDA, AMENDING THE CITY’S COMPREHENSIVE PLAN; ADDING OR
ADOPTING REVISIONS TO THE FUTURE LAND USE, TRANSPORTATION, HOUSING, SANITARY
SEWER, POTABLE WATER, SOLID WASTE, DRAINAGE, AQUIFER RECHARGE, CONSERVATION,
RECREATION AND OPEN SPACE, INTERGOVERNMENTAL COORDINATION, CAPITAL
IMPROVEMENTS, AND AVIATION ELEMENTS OF THE COMPREHENSIVE PLAN; ADOPTING
AMENDMENTS TO THE COMPREHENSIVE PLAN ARISING FROM CHANGES RESULTING FROM THE
2010 CENSUS; UPDATING THE FUTURE LAND USE MAP; CREATING NEW LAND USE
DESIGNATIONS; ELIMINATING THE EDUCATION ELEMENT OF THE FORMER COMPREHENSIVE
PLAN; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Leesburg, Florida, on September 22, 2003, by Ordinance Number 03-90, adopted a
Comprehensive Plan which incorporated a Future Land Use Element setting forth
the goals, objectives, and policies to guide and direct future development and
growth to the year 2020; and
WHEREAS, the City Commission
has determined that it is in the best interest of the health, safety, and
welfare of the citizens of the City of Leesburg, to adopt a new Comprehensive
Plan to govern land use and development through the year 2035.
NOW
THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, AS
FOLLOWS:
SECTION
1.
The City of Leesburg
2035 Comprehensive Plan, as attached hereto and incorporated herein, is hereby
ordained and adopted as the City of Leesburg’s Comprehensive Plan through the
year 2035.
City staff is
authorized and directed to transmit the 2035 Comprehensive Plan to the Florida
Department of Economic Opportunity (FDEO) Division of Community Planning and Development,
which is requested to provide an expedited review of the Plan.
SECTION
II.
If any portion of this ordinance is
declared invalid or unenforceable, then to the extent it is possible to do so
without destroying the overall intent and effect of this ordinance, the portion
deemed invalid or unenforceable shall be severed herefrom and the remainder of
this ordinance shall continue in full force and effect as if it were enacted
without including the portion found to be invalid or unenforceable.
SECTION
III.
All ordinances or parts of ordinances
which are in conflict with this ordinance are hereby repealed, to the extent
necessary to alleviate the conflict, but shall continue in effect insofar as
they are not in conflict herewith, unless repeal of the conflicting portion
destroys the overall intent and effect of any of the conflicting ordinances, in
which case those ordinances so affected shall be hereby repealed in their
entirety.
SECTION
IV.
The effective
date of this Ordinance shall be the date the state land planning agency issues
a final order determining the Comprehensive Plan, as attached hereto and
amended prior to this Ordinance becoming effective, to be in compliance with
Chapter 163, Florida Statutes, or the date the Division of Administrative
Hearings issues a final order determining the adopted 2035 Comprehensive Plan
to be in compliance with Chapter 163, Florida Statutes, whichever occurs first.
