Subject:                      Resolution authorizing execution of an On System Maintenance Agreement with the State of Florida, Department of Transportation for a portion of the Tavares-Leesburg Trail along US Hwy 441 between Canal Street and Bentley Road

Staff Recommendation:

Staff recommends execution of the maintenance agreement between the City and the State of Florida, Department of Transportation.

Analysis:

The City of Leesburg has been approached by the Florida Department of Transportation (FDOT), regarding an upcoming project that will affect portions of the right-of-way along US Highway 441.  With the successful transfer of the right-of-way, the FDOT is requesting the City to enter into an On System Maintenance Agreement.  This agreement will transfer repairs to the surface and signage as related to this section of trail to the City of Leesburg.  The FDOT will continue to maintain, mow and repair as normal.  This project is currently not funded for construction.  Financial Project ID 238394-3-52-01.

Options:

1.  Approve the execution of the agreement as stated, or,

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

Estimated annual costs to maintain the 12’ trail are deemed minimal – crack sealing, minor edge repairs and restriping when needed.

RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN ON SYSTEM MAINTENANCE AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") FOR THE PURPOSE OF PROVIDING FOR COMPLETION BY FDOT OF A PORTION OF THE TAV-LEE TRAIL ALONG U.S. HIGHWAY 441 BETWEEN CANAL STREET AND BENTLEY ROAD, AND FOR THE MAINTENANCE OF THAT TRAIL SUBSEQUENT TO ITS COMPLETION; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized and directed to execute an On System Maintenance Agreement between the City of Leesburg and FDOT, for the purpose of providing for completion by FDOT of a portion of the Tav-Lee Trail along U.S. Highway 441 between Canal Street and Bentley Road, and for the maintenance of that trail subsequent to its completion.

THIS resolution shall take effect upon its passage and adoption according to law.
