Subject:                      Rezoning:  16.3 acres for Lucille W. Deems from City RE-1 to R-1

 

 

Staff Recommendation:

The Planning staff and Planning Commission recommend approval of the proposed rezoning for the subject property from City RE-1 (Estate Density Residential) to R-1 (Low Density Residential).

 

Analysis:

The project site is approximately 16.3 acres.  The property is generally located at the southwest corner of Old Tavares Road and Sleepy Hollow Road, as shown on the attached General Location Map.  The present zoning for this property is City RE-1 (Estate Density Residential).  Currently, the property is undeveloped.  The proposed use of the site is a single family residential development.  The surrounding zoning designations are County C-2 (Community Commercial) and City R-2 (Medium Density Residential), R-1 (Low Density Residential) and R1-A (Single Family Residential).

 

The proposed zoning district of City R-1 (Low Density Residential) is compatible with adjacent and nearby properties in the area.  The density per the Developer’s Agreement permits 3.0 units per acre which is in compliance with the approved Sunnyside Study for the property.

 

The zoning district above is compatible with the proposed City future land use designation of LD (Low Density Residential).

 

The existing land uses surrounding the property are undeveloped and single family residential development.

 

Development of the parcels shall require connection to City utilities at the owner’s expense.

 

By a vote of 7 to 0, the Planning Commission recommended approval.

 

Options:

1.  Approve the proposed rezoning to City R-1 (Low Density Residential), thereby allowing                                 consistent zoning and development standards for the area.

2.    Disapprove the proposed rezoning.

3.    Such alternative action as the Commission may deem appropriate

 

Fiscal Impact: 

There is no fiscal impact to the City.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, REZONING APPROXIMATELY 16.3 ACRES GENERALLY LOCATED AT THE SOUTHWEST CORNER OF OLD TAVARES ROAD AND SLEEPY HOLLOW ROAD, LYING IN SECTIONS 20, TOWNSHIP 19 SOUTH, RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM CITY RE-1 (ESTATE DENSITY RESIDENTIAL) TO CITY R-1 (LOW DENSITY RESIDENTIAL); AND PROVIDING AN EFFECTIVE DATE.

 

BE IT ENACTED BY THE PEOPLE  OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1.

 

            Based upon the petition of Lucille W. Deems, the owner of the property hereinafter described, which petition has heretofore been approved by the City Commission of the City of Leesburg, Florida, pursuant to the provisions of the Laws of Florida, the said property located in Lake County, Florida, is hereby rezoned from City RE-1 (Estate Density Residential) to City R-1 (Low Density Residential), to-wit:

Section 2.

 

            This ordinance shall become effective upon its passage and adoption, according to law.
