accepting a Quit Claim Deed from the Trust for Public Land for various railroad
properties.
Staff Recommendation:
Staff
recommends acceptance of the fully executed Quit Claim Deed from the Trust for
Public Land for various railroad properties as described in Exhibit A to the
deed.
Analysis:
As a part of
the Florida Forever grant program, Tthe
City of Leesburg purchased several sections of abandoned CSX railroad from the tTrust for Public
Lands. through an agreement with the
Trust for Public Land. The
acceptance of this Quit Claim Deed completes this transaction.
Options:
1. Accept Quit Claim Deed; or
2. Such alternative action as the Commission may
deem appropriate

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA,
ACCEPTING A QUIT CLAIM DEED GIVEN FOR BY THE TRUST FOR PUBLIC LAND, AS
GRANTOR, TO THE CITY OF LEESBURG, AS GRANTEE, PERTAINING TO LAND LOCATED AS
DESCRIBED IN EXHIBIT “A” TO THE DEED; AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF
LEESBURG, FLORIDA, that:
Section 1.
The
City of Leesburg, Florida does hereby accept from the Trust for Public Land a
Quit Claim Deed dated December 22, 2005, and recorded in Official Records Book
03047, Page 1178-1247, Public Records of Lake County Florida, conveying certain
real property located in Lake County, Florida as described in Exhibit “A” to
the deed.
Section 2.
If
any portion of this ordinance is declared or invalid or unenforceable, then to
the extent it is possible to do so without destroying the overall intent and
effect of this ordinance, the portion deemed invalid or unenforceable shall be
severed herefrom and the remainder of this ordinance shall continue in full
force and effect as if it were enacted without including the portion found to
be invalid or unenforceable.
Section 3.
This
ordinance shall become effective upon its passage and adoption according to
law.

CSX TRANSPORTATION RAILROAD RIGHT OF WAY; AND PROVIDING AN EFFECTIVE DATE.
