Staff Recommendation:
The Planning staff and Planning Commission recommend
approval of the proposed rezoning for the subject property from County R-1
(Rural Residential) to City R-1 (Low Density Residential).
Analysis:
The
project site is approximately .92 acres.
The property is generally located south of U.S. 441, at the northwest
corner of Pringle and Purdum Avenues, as shown on the attached General Location
Map. The present zoning for this property is County R-1 (Rural Residential).
Currently, the property is partially undeveloped and has a vacant single-family
residence. The proposed use of the site is two single-family residences with a reverse City frontage road on the north
boundary. The surrounding zoning
designations are County R-1 (Rural Residential) and RP
(Residential-Professional) and City C-3 (Highway Commercial).
The proposed zoning district of City R-1 (Low
Density Residential) is compatible with adjacent and nearby properties in the
area and with the proposed City future land use designation of LD (Low Density
Residential).
The
existing land uses surrounding the property are office/commercial uses to the
north and single family residential development.
Development of the parcel shall require connection
to City utilities at the owner’s expense.
By
a vote of 6 to 0, the Planning Commission recommended approval.
Options:
1. Approve
the proposed rezoning to City R-1 (Low Density Residential), thereby allowing
consistent zoning and development standards for the area.
2. Disapprove the proposed rezoning.
3. Other such action as the Commission may deem appropriate.
Fiscal Impact:
There
is no fiscal impact to the City.

REZONING APPROXIMATELY .92 ACRES GENERALLY LOCATED SOUTH OF U.S. 441, AT THE NORTHWEST
CORNER OF PRINGLE AND PURDUM AVENUES, LYING IN SECTION 22, TOWNSHIP 19 SOUTH,
RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY R-1 (RURAL RESIDENTIAL) TO
CITY R-1 (LOW DENSITY RESIDENTIAL); AND PROVIDING AN EFFECTIVE DATE.

Section 1.
Based upon the petition of Ronald L. Hart, Jr. and
Benjamin Garcia, Jr., the owners of the property hereinafter described, which
petition has heretofore been approved by the City Commission of the City of
Leesburg Florida, pursuant to the provisions of the Laws of Florida, the said
property located in Lake County, Florida, is hereby rezoned from County R-1
(Rural Residential) to City R-1 (Low
Density Residential), to-wit:

THE PLANNING
& ZONING DIVISION RECOMMENDS:
APPROVAL of the applicant’s amended request
for the
following reason(s):
1. The
proposed zoning district of R-1 (Low Density Residential) is compatible with
the proposed City future land use designation of LD (Low Density).
2. The
proposed zoning district of R-1 (Low Density Residential) is compatible with
adjacent zoning classifications of County R-1 (Rural Residential) and County RP
(Residential Professional) and is compatible with nearby and adjacent
residential land uses along Pringle Avenue and Purdam Avenue.
3. The
proposed residential use would be an extension of the adjacent residential uses
in the area and does not appear to create a detrimental effect on adjacent or
surrounding properties.
4. Rezoning
of the subject property is consistent with the City’s adopted Growth Management
Plan, Future Land Use Element, and Goal I, Objective 1.6, Policy 1.6.3.
SUBJECT to
the following comments:
Development
of the properties shall be subject to all applicable City requirements,
including, but not limited to site plan and building plan review processes and
the assessment of impact fees.
Development
of the parcels shall require connection to City utilities at the owner’s
expense.
Property
owners shall provide utility easements as required by all utility providers.
Vehicular
access to the sites shall be coordinated with the Lake County Public Works
Department and the City of Leesburg.
Staff
recommends approval of the proposed rezoning subject to the property receiving
a Small Scale Comprehensive Plan Amendment Future Land Use Designation of LD (Low
Density), under Planning and Zoning Case number 044-0-040606.
