SUBJECT: An Ordinance approving Large Scale Comprehensive Plan Amendment: JK Ventures/John Smith
Staff Recommendation
The Planning staff recommends approval of the proposed amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from County Urban Expansion to City Low Density Residential. The Planning Commission will hold a hearing on this request on May 18, 2006.
Analysis
The
project site is approximately 14 acres. The general location is east of US
Highway 27 and south of Commander
Road. The project site is larger
than ten (10.0) acres and is, therefore, considered a
large-scale comprehensive land use plan amendment under state statutes. The
City will notify the Florida Department of Community Affairs of the plan
amendment and the Department will review the project site area to confirm that
it is larger than ten (10) acres.
The project site is currently undeveloped and the surrounding Future Land Use Map designations are:
North – County Urban Expansion
South – County Urban Expansion
East – County Urban Expansion
West – City Commerce
The Land Use for the property is currently County Urban Expansion. The proposed designation of City Low Density Residential is consistent with the City’s adopted Comprehensive Plan.
The existing land uses surrounding the property are:
North – undeveloped and single family residential
South – undeveloped
East – mobile home park
West – undeveloped
Presently, as referenced above, the site is undeveloped. The proposed use of the site is single family residential development.
Water and sewer services are available in the area. The provision of utilities to this site is not likely to have significant adverse effects on the City’s utility systems. The developer is responsible for all costs of construction to make the necessary hook-ups to City utilities in accordance with City requirements.
Options:
1. To approve or disapprove the proposed City Future Land Use Map amendment designating the site as City Low Density Residential.
2. Such alternative action as the Commission may deem appropriate.
Fiscal Impact:
This large-scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 14 ACRES AND GENERALLY LOCATED EAST OF US HIGHWAY 27 AND SOUTH OF COMMANDER ROAD, LYING IN SECTION 14, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN EXPANSION TO CITY LOW DENSITY RESIDENTIAL; AND PROVIDING AN EFFECTIVE DATE (JK VENTURES/JOHN SMITH).
WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and which has made recommendations to the City Commission for amendment of the Plan; and
WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public;
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:
The Future Land Use Map is amended by changing the designation of an approximate 14 acre parcel of land generally located east of US Highway 27 and South of Commander Road, lying in Section 14, Township 20 South, Range 24 East, Lake County, Florida, legally described as:
Commence at the Northwest corner of the Northeast ¼ of Section 14, Township 20 South, Range 24 East in Lake County, Florida, and run South 89°26’46” East along the North line of the Northeast ¼ a distance of 474.06 feet to a point on the East right-of-way line of U.S. Highway No. 27, said point being a nail in tab in pavement labeled LB707; thence South 11°00’00” East along said Easterly right-of-way line of U.S. Highway No. 27, a distance of 25.40 feet to a point on the South right-of-way line of Commander Road; said point being an iron pin labeled LB707; thence South 89°26’46” East along said South right-of-way line of Commander Road, a distance of 306.20 feet to an iron pin labeled LB707 and the point of beginning of this description; from said point of beginning, continue South 89°26’46” East along said South right-of-way line of Commander Road 337.78 feet to an iron pin labeled LB707; thence leaving said South right-of-way line, run South 0°28’37” West, 187.98 feet to an iron pin labeled LB707; thence South 89°26’43” East, 200.00 feet to an iron pin labeled LB707; thence North 0°28’37” East, 67.98 feet to an iron pin labeled LB707; thence South 89°26’43” East, 165.30 feet to an iron pin labeled LB707; thence continue South 89°26’43” East, 130.45 feet to the centerline of the right of way of the Palatlakaha River; said right of way being 200 feet in width; thence Southwesterly along and with said centerline of the Palatlakaha River right-of-way; said right of way being 200 feet in width and lying 100 feet each side of the following described centerline; thence South 46°20’59” West, 13.28 feet; thence South 76°15’09” West, 139.00 feet; thence South 08°58’09” West, 107.00 feet; thence South 54°35’51” East, 187.00 feet; thence South 03°36’09” West 167.00 feet; thence South 66°04’39” West, 267.00 feet; thence South 02°23’09” West, 261.00 feet; thence South 23°08’09” West, 264.14 feet to a point hereby designated as Point “A”; return to the point of beginning and run South 11°00’00” East, parallel with the Easterly right-of-way line of U.S. Highway No. 27 a distance of 1228.23 feet to an iron pin labeled LB707; thence North 79°00’00” East, 103.34 feet to a concrete monument labeled LB707; thence continue North 79°00’00” East, 120.82 feet to intersect the aforementioned Point “A”, LESS that part lying in the Southwest ¼ of the Northeast ¼ of the Northeast ¼ of Section 14, Township 20 South, Range 24 East in Lake County, Florida.

Section 2.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
