Subject: Ordinance amending §§ 22-211 and 22-227 of the Code of Ordinances, pertaining to water and wastewater rates, to add to each a rate schedule for use with meters which measure water consumption in gallons rather than in cubic feet
Staff Recommendation:
Staff recommends approval of the ordinance amending Sections 22-211 and 22-227 of the Code of Ordinances pertaining to water and wastewater rates, to add to each a rate schedule for use with meters which measure water consumption in gallons rather than in cubic feet
Analysis:
The City is in the process of acquiring Lake Utility Company which provides water and wastewater service to The Plantation at Leesburg. The existing water meters measure consumption in gallons, rather than in cubic feet. Our present meters measure in cubic feet and our water and wastewater rates are structured accordingly.
In order to facilitate an orderly transition, and to avoid the significant unnecessary expense of exchanging some 3,000 meter with cubic feet meters, the proposed rate schedule establishes water and sewer rates for meters which read in gallons.
The proposed gallon rates are calculated based upon our current rate structure, and duplicate it as much as possible for any given level of consumption. Because the conversion between gallons and cubic feet is fractional, and because both are measured in whole units for purposes of billing, there are some minor differences (in pennies) between the two schedules for any given level of consumption. Overall, the rate schedule is revenue neutral with respect to our existing cubic feet based rates.
Options:
1. Approve the ordinance as presented, or;
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Implementation of this ordinance will establish a gallon-based rate structure which is revenue neutral with respect to our existing cubic feet-based water and sewer rates. There is no significant fiscal impact.

ORDINANCE NO. ______
AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING §22-211 AND 22-227 OF THE CODE OF ORDINANCES, PERTAINING TO WATER AND WASTEWATER RATES, TO ADD TO EACH A RATE SCHEDULE FOR USE WITH METERS WHICH MEASURE WATER CONSUMPTION IN GALLONS RATHER THAN IN CUBIC FEET; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Leesburg provides potable water and wastewater services to its utility customers, which it has customarily billed using meters which measure consumption in cubic feet, and
WHEREAS, due to expansion of the utility system into new areas and acquisition of systems formerly operated by other utility providers, the City has or will shortly have customers using meters which measure consumption in gallons, and
WHEREAS, it is necessary to promulgate a rate schedule which imposes charges per number of gallons, to supplement the existing rate schedule based on cubic feet of consumption,
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA:
SECTION I.
§22-211 of the Code of Ordinances of the City of Leesburg, Florida, is hereby amended to add thereto a subsection 22-211(a)(5) to read as follows:
(5) For customers whose consumption of water or reuse water is measured by meters which read out in gallons rather than cubic feet, the following rates shall apply:
COMMERCIAL:
Availability charge, exclusive of use: . $7.00
All usage: $1.08868 per 1,000 gallons
RESIDENTIAL:
Availability charge, exclusive of use: .. $7.00
0-8000 gallons .. $0.89000 per 1,000 gallons
8,001 gallons to 15,000 gallons $1.21000 per 1,000 gallons
15,001 gallons to 33,000 gallons .. $1.59000 per 1,000 gallons
Over 33,000 gallons $2.2000 per 1,000 gallons
The 25% surcharge on rates to customers outside the municipal limits shall apply to this rate schedule as it does to the schedule based on measurement by cubic feet of usage.
SECTION II.
§22-227 of the Code of Ordinances of the City of Leesburg, Florida, is hereby amended to add thereto the following, without otherwise affecting the existing portions of such ordinance:
Charges for pollution abatement for customers whose water usage is measured by meters which read out in gallons rather than cubic feet shall be assessed according to the following schedule:
AVAILABILITY CHARGES (EXCLUSIVE OF USE)

Commercial IV 1 (for each 3 units) $25.06

Residential $0.83175 per 1,000 gallons*
Commercial Class I $1.369 per 1,000 gallons
Commercial Class II .. $1.70508 per 1,000 gallons
Commercial Class III . $2.12090 per 1,000 gallons
Commercial Class IV 1 .. $0.83175 per 1,000 gallons
Commercial Class IV 2 .. $0.83175 per 1,000 gallons
*NOTE: Residential usage charges capped at 11,000 gallons per month

SECTION III.
If any portion of this ordinance is declared invalid or unenforceable, then to the extent it is possible to do so without destroying the overall intent and effect of this ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of this ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable.
SECTION IV.
All ordinances or parts of ordinances which are in conflict with this ordinance are hereby repealed, to the extent necessary to alleviate the conflict, but shall continue in effect insofar as they are not in conflict herewith, unless repeal of the conflicting portion destroys the overall intent and effect of any of the conflicting ordinances, in which case those ordinances so affected shall be hereby repealed in their entirety.
SECTION V.
This ordinance shall become effective upon its passage and adoption according to law.
