Subject:                      Resolution approving the form and content of the Standard Agreement to be utilized for “Independent Contractors” providing Recreational/Instructional Services to Citizens of Leesburg and General Public

Staff Recommendation:

Staff recommends approval of the standard agreement to be used for “Independent Contractors” to provide recreational/instructional services to citizens of Leesburg and the general public.

Analysis:

The City of Leesburg has provided recreational/instructional services to the citizens of Leesburg and to the general public for many years without a formal contract.  The attached agreement will provide a binding contract between the City of Leesburg and a contractor for services rendered.

The City of Leesburg Recreation & Parks Department will register all participants for the recreational/instructional services and shall collect and record all fees. The “contractor” shall be entitled to 80% of all fees collected as payment for services. 

Options:

1.  Approve the form and content of the standard agreement for Recreational/Instructional services

     or;

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

There will be no fiscal impact for this contract.  Funds have been allocated in fiscal year budget 05/06 Recreation budget and in previous fiscal years budget for these programs.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, APPROVING THE FORM AND CONTENT OF A STANDARD AGREEMENT TO BE UTILIZED BY THE CITY FOR INDEPENDENT CONTRACTORS TO PROVIDE RECREATIONAL/INSTRUCTIONAL SERVICES TO CITIZENS OF LEESBURG AND THE GENERAL PUBLIC; AND PROVIDING AND EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Commission hereby approves the form and content of a standard agreement to be used for Independent Contractor to provide Recreational/Instructional services to the residents of the City of Leesburg, Florida and to the general public

 THAT this resolution shall become effective immediately.
