Subject:                      Resolution authorizing execution of  Supplemental Amendment No. 3 to the Joint Participation Agreement with the Florida Department of Transportation for Landscaping Improvements on US 441 – Between College Drive and CR473.

 

Staff Recommendation:

Staff recommends approval of the resolution authorizing the Mayor and City Clerk to execute Supplemental Amendment No. 3 to Florida Department of Transportation’s Joint Participation Agreement.

 

Analysis:

The City Commission approved a JPA with the Florida Department of Transportation (FDOT) to provide $250,000 for landscape improvements on US Hwy 441 in August, 2004.  In November, 2004, the Commission approved Supplemental Amendment No. 1 to correct the boundaries of the project.  When staff discovered limerock and other debris in the center medians, FDOT increased the original JPA by $320,000 for a total of $570,000 and the Commission approved Amendment No. 2.

 

The original JPA is good for only two years, and is due to expire on September 9, 2006, staff requests approval of Supplemental Amendment No. 3 to extend the JPA for an additional six months to insure completion of Phase 1 of this project.  The City of Leesburg has budgeted $228,000 for these landscape improvements.

 

After the FDOT Landscape Engineer reviewed the proposed landscape design, they  requested  the City add paragraph 8.(g) to read as follows.

 

            8.(g)  The LOCAL GOVERNMENT shall be responsible for any future damage to the existing roadways caused by large trees installed in the medians as part of the Landscaping Improvements, which is the subject of this Joint Participation Agreement.

 

Options:

1.      Authorize execution of Supplemental Amendment No. 3 to extend the JPA with FDOT for landscape improvements; or

2.      Such other alternative action as the Commission may deem appropriate.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENTAL  AMENDMENT NO. 3 TO EXTEND THE EXPIRATION DATE OF THE JOINT PARTICIPATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR LANDSCAPING IMPROVEMENTS ON US 441 BETWEEN COLLEGE DRIVE AND CR 473 TO MARCH 9,  2007; AND PROVIDING AN EFFECTIVE DATE:

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

            THAT the Mayor and City Clerk are hereby authorized to execute Supplemental Amendment No. 3 with the State of Florida, Department of Transportation to extend the expiration date of the JPA to March 9, 2007 for landscape improvements along US Hwy 441 between College Drive and CR 473.

 

             THAT this resolution shall become effective immediately.
