SUBJECT:                  Ordinance for Large Scale Comprehensive Plan Amendment for Woodrell

 

 

Staff Recommendation

The Planning staff recommends approval of the proposed amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from County Urban to City Low Density Residential. The Planning Commission held a hearing on this request September 7, 2006.

 

Analysis

The project site is approximately 24 acres. The general location is south of Park Holland Road, east of Picciola Road. The project site is larger than ten (10.0) acres and is, therefore, considered a large-scale comprehensive land use plan amendment under state statutes. The City will notify the Florida Department of Community Affairs of the plan amendment and the Department will review the project site area to confirm that it is larger than ten (10) acres.

 

The project site is currently undeveloped and the surrounding Future Land Use Map designations are:

                        North   –  County Urban

                        South   –  County Urban and City Conservation

                        East     –  Lake Griffin

                        West    –  County Urban and Employment Center

 

The Land Use for the property is currently County Urban. The Annexation Agreement will require future rezoning to Planned Unit Development (PUD) by the developer, which will be consistent with the City’s adopted Comprehensive Plan.

 

The existing land uses surrounding the property are:

           

                        North   –  undeveloped and single family residential

                        South   –  undeveloped

                        East     –  undeveloped, single family residential

                        West    –  undeveloped and single family residential

 

Presently, as referenced above, the site is undeveloped. The proposed use of the site is for residential development.

 

Water and sewer services are available at the intersection of Park Holland Road and Picciola Road and will be extended by the developer to this site.

 

Options:

 

1.      To approve or disapprove the proposed City Future Land Use Map amendment designating the site as City Low Density Residential.

 

2.      Such alternative action as the Commission may deem appropriate. 

 

Fiscal Impact:

This large-scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 24 ACRES AND GENERALLY LOCATED SOUTH OF PARK HOLLAND ROAD, EAST OF PICCIOLA ROAD, LYING IN SECTION 14, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN TO CITY LOW DENSITY RESIDENTIAL; AND PROVIDING AN EFFECTIVE DATE (WOODRELL).

 

WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and has made recommendations to the City Commission for amendment of the Plan; and

 

WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public; 

 

NOW, THEREFORE,

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1

 

The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:

 

The Future Land Use Map is amended by changing the designation of an approximate 24 acre parcel of land generally located south of Park Holland Road, lying in Section 14, Township 19 South, Range 24 East, Lake County, Florida, legally described as:

 

Commence at the Northwest corner of Government Lot 2, Section 14, Township 19 South, Range 24 East, Lake County, Florida, run East along the North line of said Government Lot 2, a distance of 1584 feet to a concrete monument to the Point of Beginning of this description; run thence South 400 feet; thence continue South 470 feet, more or less, to a one-half inch diameter iron rod, eighteen inches in length, with plastic survey cap marked D. Melvin LS 4033, the top of said iron being set at ground level; thence continue South to a point on the South line of said Government Lot 2; thence West along said South line to a point which is 755 feet East of the West line of said Government Lot 2; thence North 438 feet; thence East 399 feet to a point which is 1154 feet East of the West line of said Government Lot 2; thence North 882 feet to the North line of said Government Lot 2; thence East to the Point of Beginning.

Holland and Helen M. Holland, his wife, on May 22, 1964, recorded in Official Records Book 262, page 899, Public Records of Lake County, Florida; run thence South 00o18’30” West parallel with the West line of said Government Lot 2 a distance of 250 feet to a concrete monument; run thence East 40 feet to a concrete monument; run thence North 81o46’26” East, a distance of 393.99 feet to a concrete monument; run thence North 81o46’26” East (being the same course) to the waters of Lake Griffin; run thence Southerly along and with the waters of said Lake Griffin without regard to any artificial canals to a point on the South line of said Government Lot 2; run thence West along the South line of said Government Lot 2, to a point which is South of the Point of Beginning; run thence North to a one-half inch diameter iron rod, eighteen inches in length, with plastic survey cap marked D. Melvin LS 4033, the top of said iron being set at ground level and being 470 feet South of the said Point of Beginning; thence continue North 470 feet, more or less to the point of Beginning.

Section 2.   

 

All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.

This ordinance shall become effective upon its passage and adoption, according to law.
