SUBJECT: Ordinance for Large Scale Comprehensive Plan Amendment: Green Leaf Development
Staff Recommendation
The Planning staff recommends approval of the proposed amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from County Urban Expansion to City Estate Residential. The Planning Commission held a hearing on this request September 7, 2006.
Analysis
The project site is approximately 96 acres. The general location is east of the intersection of CR 48 and US Hwy 27. The project site is larger than ten (10.0) acres and is, therefore, considered a large-scale comprehensive land use plan amendment under state statutes. The City will notify the Florida Department of Community Affairs of the plan amendment and the Department will review the project site area to confirm that it is larger than ten (10) acres.
The project site is currently undeveloped and the surrounding Future Land Use Map designations are:
North – Lake Harris
South – County Urban Expansion
East – County Urban Expansion
West – City Estate Residential
The Land Use for the property is currently County Urban Expansion. The Annexation Agreement will require future rezoning to Planned Unit Development (PUD) by the developer, which will be consistent with the City’s adopted Comprehensive Plan.
The existing land uses surrounding the property are:
North – Lake Harris
South – undeveloped
East – undeveloped
West – undeveloped and single family residential
Presently, as referenced above, the site is undeveloped. The proposed use of the site is for residential development.
Water and sewer services are currently being extended eastward from US Hwy 27 along CR 48 to a development located west of this site. The developer of Green Leaf will be required to extend them to this site.
Options:
1. To approve or disapprove the proposed City Future Land Use Map amendment designating the site as City Estate Residential.
2. Such alternative action as the Commission may deem appropriate.
Fiscal Impact:
This large-scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

ORDINANCE NO. ______
AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 96 ACRES AND GENERALLY LOCATED ON THE NORTH SIDE OF CR 48, WEST OF NO. 2 ROAD, LYING IN SECTION 12, TOWNSHIP 20 SOUTH, RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN EXPANSION TO CITY ESTATE RESIDENTIAL; AND PROVIDING AN EFFECTIVE DATE (GREEN LEAF).
WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and has made recommendations to the City Commission for amendment of the Plan; and
WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public;
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:
The Future Land Use Map is amended by changing the designation of an approximate 96 acre parcel of land generally on the north side of CR 48, west of No. 2 Road, lying in Section 12, Township 20 South, Range 25 East, Lake County, Florida, legally described as:
The East 643.5 feet of Government Lot 5, in Section 12, Township 20 South, Range 24 East, together with an easement for ingress and egress described as follows: The East 10 feet of the Northeast ¼ of the Northeast ¼, Section 13, Township 20 South, Range 24 East, Lake County, Florida.
And
The West 260 feet of the West ½ of Government Lot 2, in Section 7, Township 20 South, Range 25 East, Lake County, Florida. The West 260 feet of the West ½ of Government Lot 1, in Section 18, Township 20 South, Range 25 East, in Lake County, Florida. That part of the West 260 feet of the West ½ of Government Lot 2, in Section 18, Township 20 South, Range 25 East, in Lake County, Florida, lying North of the right-of-way of state highway.
And
The East 761.5 feet of the West 1021.5 feet of Government Lot 2, Section 7, and the East 761.5 feet of the West 1021.5 feet of Government Lot 1, and the East 761.5 feet of the West 1021.5 feet of Government Lot 2, North of Highway, in Section 18, Township 20 South, Range 25 East, Lake County, Florida.
And
That part of the Northwest ¼ of the Northwest ¼ of Section 18, Township 20 South, Range 25 East, in Lake County Florida, lying East of a line beginning 150 feet West of the Northeast corner of said Northwest ¼ of the Northwest ¼ and running due South to the Northerly line of the right-of-way of State Road No. 48.
And
That part of the Southwest ¼ of the Southwest ¼ of Section 7, Township 20 South, Range 25 East, in Lake County, Florida, lying East of a line beginning 150 feet due West of the Southeast corner of said Southwest ¼ of the Southwest ¼ and running due North to Lake Harris.
And
That part of the East ½ of Government Lot 1 in Section 18, Township 20 South, Range 25 East, in Lake County, Florida, lying West of the following described line: From the Northeast corner of said Government Lot 1, run North 89o47’30” West along the North line of Government Lot 1 a distance of 646.98 feet to the Point of Beginning of said line; thence South 09o55’ West to the Northerly line of the right-of-way of State Road No. 48 and the end of said line.

Section 2.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
Section 3.
This ordinance shall become effective upon its passage and adoption, according to law.
