Subject:                      Resolution authorizing Utility Service Agreement with Highland Cassidy, LLC to provide water and wastewater service to Waterfront Estates, west of US 27, and south of The Plantation at Leesburg

Staff Recommendation:

Staff recommends approval of the utility service agreement with Highland Cassidy, LLC to provide water and wastewater service to Waterfront Estates.

Analysis:

This utility service agreement requires the developer to construct water and wastewater infrastructure at its own expense, to be conveyed to the city upon final inspection and acceptance.  It also provides that the developer must construct a 12” water main extension at its own expense.

Options:

1.  Approve the Utility Service Agreement, or;

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

The City will incur normal operating costs associated with the infrastructure.  These costs will be offset by revenues derived from utility bills for this subdivision.

A RESOLUTION OF THE CITY COMMISSION OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A UTILITY SERVICE AGREEMENT WITH HIGHLAND CASSIDY, LLC TO PROVIDE WATER AND WASTEWATER SERVICE TO WATERFRONT ESTATES ON SOUTH U.S. HIGHWAY 27; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute a utility service agreement  with Highland Cassidy, LLC whose address is 295 First Street South, Winter Haven, Florida 33880.

 THAT this resolution shall become effective immediately.
