Subject:                      Resolution approving the Paid Time Off (PTO) Policy

 

 

Staff Recommendation:

Staff recommends adoption of the resolution repealing Personnel Policies 311 Vacations and 227.0 Sick Leave And Sick Bank; establishing Policy 311 Paid Time Off (PTO), and amending Policy 810 Employee Separation.  All City Employees affected by the proposed change participated in an election held December 1, 2006, at which time the employees cast 324 YES votes and 99 NO votes (76.5% voting in favor).

 

Analysis:

Currently the City maintains the Vacation Policy which governs granting paid leave to employees for activities other than illness or medical needs, and the Sick Leave Policy which grants paid absence from work by reason of personal illness, accident, pregnancy supported by a doctor’s recommendation or serious illness in the immediate family.

Under the current Sick Leave Policy, full-time employees earn four (4) hours of sick leave credit for each biweekly pay period commencing with the completion of the first ninety (90) days of employment.  Employees covered by a collective bargaining agreement accrue similar time in accordance with that collective bargaining agreement.

Under the current Vacation Policy, the annual leave entitlement accrues for each full-time employee from the employee’s date of hire at varying rates, depending upon length of service, from 10 days for employees with 5 years of service or less, to a maximum of 20 days for employees with 19 years or more of service.

PTO is a combination of vacation and sick leave.  The opening paragraph of the policy states: “The City encourages each employee to use their annual PTO entitlement as paid time off for purposes such as vacation, leisure time, personal illness, or care for family member(s) who may be ill.  ” 

Under this PTO policy, employees will continue to earn paid leave at the same rates as they currently receive sick leave and vacation leave while having greater flexibility and discretion in the use of that earned time.  This policy will also provide supervisors greater control of when employees are granted time away from work to meet the demands of service for each particular work group.

Employee Separation (Policy No. 810) Section C (Benefits at Termination) is being amended to change the references in the section from Sick Leave and Vacation Leave to Paid Time Off, and to reflect the changes to the new leave policy.

Options:

1.  Adopt the resolution; or

2.  Such alternative action as the Commission may deem appropriate.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, REPEALING PERSONNEL POLICY NUMBER 311 (VACATION) AND POLICY NUMBER 227.0 (SICK LEAVE AND SICK BANK), AMENDING POLICY 810 (EMPLOYEE SEPARATION), AND ADOPTING PERSONNEL POLICY NUMBER 311 PAID TIME OFF (PTO); AND PROVIDING AN EFFECTIVE DATE.

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

THAT upon direction of the Personnel Committee, the Human Resources  Department conducted an election of all employees affected by the proposed changes  December 1, 2006 to determine if it is their desire to change from separate Vacation and Sick policies to a unified policy for Paid Time Off;

THAT the results of that election were 324 votes in favor of a PTO Policy, and 99 votes in opposition, or 76.5% voting in favor of the policy;

THAT the Personnel Committee, based upon that election, endorses this change in policy;

THAT this resolution shall become effective immediately.

NOW THEREFORE be it resolved by the City Commission of the City of Leesburg, Florida, that Policy 311 (Vacation) and Policy 227.0 (Sick Leave and Sick Bank) are repealed, and Policy 311 Paid Time Off (PTO) is adopted as attached hereto; and, that Policy 810 Employee Separation is hereby amended as attached hereto.
