Subject:                      Resolution authorizing an Interlocal Agreement for Transfer of Jurisdiction and Right of Way Annexation

 

 

Staff Recommendation:

Staff recommends execution of the Interlocal Agreement for Transfer of Jurisdiction and Right of Way Annexation for a portion of South Quarters Road lying within the proposed Windy Oaks Subdivision.

 

Analysis:

 

During the review of the proposed subdivision plat for the Windy Oaks Subdivision it was learned that the County owned South Quarters Road.  The developer desires to realign the roadway, and will pay all of the costs associated with rebuilding the roadway on the new alignment.  The property owner, with the City’s consent, approached the County and requested that the right-of-way be vacated (the new alignment would be dedicated to the public through the Windy Oaks Subdivision plat).  The County prefers to transfer title to the road right-of-way to the City and have the City vacate and approve the plan for realignment.  To accomplish this, the County has prepared the attached Interlocal Agreement and has requested that we sign and return it to them for the County Commissioner’s approval.

 

Options:

1.  Approval of staff recommendation, or

2.  Such alternative action as the Commission may deem appropriate

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT FOR TRANSFER OF JURISDICTION AND RIGHT OF WAY ANNEXATION FOR A PORTION OF SOUTH QUARTERS ROAD IN LAKE COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. 

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

            THAT the Mayor and City Clerk are hereby authorized to execute an Interlocal Agreement between Lake County, P.O. Box 7800, Tavares, Florida 32778 and the City of Leesburg relating to a portion of South Quarters Road lying within the proposed Windy Oaks Subdivision, Right of Way and Transfer of Jurisdiction.

 

             THAT this resolution shall become effective immediately.

 

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 11th day of December 2006.
