Subject:                      Ordinance approving Large- Scale Comprehensive Plan Amendment: Drew Pastures, LLC (Triangle Lakes)

 

 

Staff Recommendation

The Planning staff recommends approval of the proposed amendment to the City’s adopted Comprehensive Plan Future Land Use Map by changing the Future Land Use classification from Lake County Suburban and Rural to City Estate Residential (E) and Conservation (CO). The Planning Commission will hold a hearing on this request on May 18, 2006.

 

Analysis

The project site is approximately 245 acres. The general location is North of the Turnpike, East of County Road 48, and West of County Road 33. The project site is larger than ten (10.0) acres and is, therefore, considered a large-scale comprehensive land use plan amendment under state statutes. The City will notify the Florida Department of Community Affairs of the plan amendment and the Department will review the project site area to confirm that it is larger than ten (10) acres.

 

The project site is currently undeveloped and the surrounding Future Land Use Map designations are:

                        North   – Estate Residential               

                        South   – County Rural

                        East     – County Employment Center

                        West    – Public

 

The Land Use for the property is currently County Suburban and Rural. The proposed designations of Estate Residential (E) and Conservation (CO) are consistent with the City’s adopted Comprehensive Plan.

 

The existing land uses surrounding the property are:

           

                        North   – Undeveloped land

                        South   – Undeveloped land

                        East     – Undeveloped land

                        West    – Undeveloped land

 

Presently, the site is undeveloped. The proposed use of the site is single family residential.

 

Water and sewer services are available in the area. The provision of utilities to this site is not likely to have significant adverse effects on the City’s utility systems. The developer is responsible for all costs of construction to make the necessary hook-ups to City utilities in accordance with City requirements.

 

Options:

 

1.      Approve or disapprove the proposed City Future Land Use Map amendment designating the site as Estate Residential (E) and Conservation (CO), as delineated on the Wetlands Map dated 03/28/05, as recommended by the staff for transmittal to the Florida Department of Community Affairs.

 

2.      Such alternative action as the Commission may deem appropriate. 

 

Fiscal Impact:

This large scale comprehensive plan amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING 245 ACRES AND GENERALLY LOCATED ON THE NORTH SIDE OF THE RONALD REAGAN TURNPIKE, BETWEEN CR 48 AND CR 33, LYING IN SECTIONS 21, 22 27 AND 28, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY SUBURBAN AND RURAL TO CITY ESTATE RESIDENTIAL AND CONSERVATION; AND PROVIDING AN EFFECTIVE DATE (TRIANGLE LAKES)

 

WHEREAS, the City Commission has received written objections, recommendations, and comments from the City of Leesburg Planning Commission acting as the Local Planning Agency, regarding amendment of the Comprehensive Plan of the City of Leesburg, and which has made recommendations to the City Commission for amendment of the Plan; and

 

WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public; 

 

NOW, THEREFORE,

 

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

 

Section 1

 

The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:

 

The Future Land Use Map is amended by changing the designation of an approximate 245 acre parcel of land generally located on the north side of the Ronald Reagan Turnpike, between CR 48 and CR 33, lying in Sections 21, 22, 27 and 28, Township 20 South, Range 24 East, Lake County, Florida, legally described as:

 

That part of Sections 21, 22, 27, and 28 of Township 20 South, Range 24 East, in Lake County, Florida, bounded and described as follows:

 

Commence at the Northeast corner of the Northwest Quarter of said Section 27, Township 20 South, Range 24 East, and run North 89 degrees 43 minutes 55 seconds West along the North line of the Northwest Quarter a distance of 50.97 feet to a point on the West right of way line of County Road No. C-33; thence South 00 degrees 26 minutes 13 seconds West along said West right of way line 487.64 feet; thence South 00 degrees 25 minutes 38 seconds West along said West right of way line 819.04 feet to the POINT OF BEGINNING of this description; from said POINT OF BEGINNING, continue South 00 degrees 25 minutes 38 seconds West along said West right of way line of County Road C-33, 1450.19 feet; thence South 12 degrees 34 minutes 16 seconds West along said West right of way line 78.39 feet; thence South 08 degrees 57 minutes 29 seconds West along said West right of way line 202.24 feet; thence South 00 degrees 25 minutes 38 seconds West, along said West right of line 424.85 feet to a point on the Northeasterly right of way line of Florida's Turnpike; thence North 43 degrees 02 minutes 13 seconds West along said Northeasterly right of way line of said Florida's Turnpike 7809.45 feet to a point on the Southeasterly right of way line of County Road C-48; thence North 45 degrees 00 minutes 29 seconds East along said Southeasterly right of way line 477.87 feet to the beginning of a curve concave Southeasterly and having a radius for 5679.58 feet; thence Northeasterly along the arc of said curve and said Southeasterly right of way line through a central angle of 10 degrees 29 minutes 10 seconds an arc length of 1039.47 feet; thence leaving said Southeasterly right of way line run South 43 degrees 02 minutes 13 seconds East, 6236.49 feet to the POINT OF BEGINNING.

Section 2.   

 

All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.

 

Section 3. 

 

This ordinance shall become effective upon its passage and adoption, according to law.
