SUBJECT: Ordinance vacating a portion of Indiana Street right-of-way approximately 30 by 250 feet for Cutrale Citrus Juices, Inc.
Staff Recommendation:
The Planning staff and Planning Commission recommend approval of the request to vacate a portion of Indiana Street right-of-way approximately 30 by 250 feet in the City of Leesburg.
Analysis:
The vacation of this approximately .78 acre right-of-way is requested by the adjacent property owner. The area to be vacated is not currently used for public access, is not needed for future access and is undeveloped. The area to be vacated will be used for the purpose of developing an additional retention pond and employee parking for expansion of the existing Cutrale Citrus Juices facility. No properties are impacted by this request since the applicant owns all the surrounding property. Utility easements, as required by the City of Leesburg, shall be provided by the property owner to allow access to all existing and/or required utility service(s) for this property.
By a vote of 7 to 0, the Planning Commission recommended approval.
Options:
1. Approve the request to vacate the right-of-way.
2. Other such action as the Commission may deem appropriate.
Fiscal Impact:
No fiscal impact is anticipated as a result of the vacation of this right-of-way.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, VACATING CERTAIN RESERVATIONS OF 30 FEET FOR PUBLIC RIGHTS-OF-WAY (.78 ACRE) AS RECORDED IN OFFICIAL RECORD BOOK 5, PAGE 34, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA, SAID PROPERTY GENERALLY LOCATED SOUTH OF MAIN STREET, EAST OF LAKE AND NORTH OF MAGNOLIA, LYING IN SECTION 25, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The City Commission of The City of Leesburg, Florida, finding that the following-described real property is not needed for public purposes, therefore the referenced reservations for public rights-of-way, legally described below, are hereby closed, vacated, abandoned and relinquished, as public rights-of-way and all rights of the public in and to said rights-of-way are vacated and abandoned:

Section 2.
The intent of this vacation is to nullify the right of the public to the use of the rights-of-way, as legally described above.
Section 3.
This ordinance shall become effective upon its passage and adoption according to law.
