Subject: Resolution approving a Subdivision Re-Plat: Royal Oaks Estates, 5th Addition: K and L Development, Inc.
Staff Recommendation
The Development Review Committee recommends approval of the proposed subdivision re-plat for Royal Oaks Estates, 5th Addition.
Analysis
The plat is situated in Section 28, Township 19S, Range 24E within the existing municipal boundary and generally located south of S.R.44 (South Street) and Casteen Road. The plat consists of 20 single family residential lots. The project is owned by K and L Development, Inc. and is being developed for attached single family homes. The City Commission originally approved this plat July 24, 2006. Several lot lines had to be adjusted, which resulted in the requirement for this re-plat.
The proposed re-plat meets the requirements of the City of Leesburg Land Development Code and Florida Statutes. The division of land is also consistent with the current zoning district of R-2 (Medium Density Residential) and the Future Land Use Map designation of MD (Medium Density Residential).
Options
1. Approve or disapprove the proposed re-plat.
2. Other such action as the Commission may deem appropriate.
Fiscal Impact
There is no fiscal impact to the City.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, ACCEPTING AND APPROVING A RE-PLAT OF ROYAL OAKS ESTATES, 5TH ADDITION, A SUBDIVISION IN AN R-2 (MEDIUM DENSITY RESIDENTIAL) DISTRICT, WITHIN THE CITY OF LEESBURG, FLORIDA, GENERALLY LOCATED SOUTH OF S.R.44 (SOUTH STREET) AND CASTEEN ROAD, LYING IN SECTION 28, TOWNSHIP 19 SOUTH, RANGE 24 EAST; AND ACCEPTING AND DEDICATING TO THE USE OF THE PUBLIC ANY EASEMENTS OR PUBLIC PLACES SHOWN THEREON AS BEING DEDICATED TO THE PUBLIC; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED by the City Commission of the City of Leesburg, Florida:
That the re-plat of the following-described land, which is named “Royal Oaks Estates, 5th Addition”, is hereby approved and accepted by the City of Leesburg, Florida:
That portion of Section 28, Township 19 South, Range 24 East, Lake County, Florida described as follows:

FURTHER RESOLVED, that all easements and other areas which are shown on the plat as being dedicated to the public are hereby accepted for municipal purposes and shall be under the care and control of The City of Leesburg, Florida.
THIS RESOLUTION shall become effective upon its passage and adoption according to law.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Leesburg, Florida, held on the 8th day of January , 2007.
