Subject: Resolution authorizing an agreement with E.R.G. Enterprises, L.L.C. to provide construction services to remove vegetation from three dry retention ponds at the Leesburg International Airport.
Staff Recommendation:
Staff recommends execution of the agreement with E.R.G. Enterprises, L.L.C. for $32,800.
Analysis:
The purpose of this project is to contract with a qualified professional to clean three dry retention ponds. This cleaning is required in order to meet Federal Aviation Administration requirements as it relates to minimizing the attraction of birds. Three ponds on the airport property have been identified as not percolating normally. This causes water to stand in the ponds which in turn attracts birds to the area. In order to minimize attracting birds, twelve inches of vegetation and soil will be excavated from each pond. The excavated material will be placed on airport property and spread evenly to dry. The material will remain on airport property.
On December 13, 2006 the Purchasing Division issued Invitation to Bid number 70081 soliciting interested and qualified firms to submit a quote for the retention pond cleaning. On January 8, 2007 14 responses to the solicitation were received. The bid tabulation is attached for your review. The lowest bid response was $19,900 lower than the next lowest bid. The Purchasing Division solicited four references from the list provided by the lowest bidder. . Two responses were received. One response was not favorable and the second agency cited their policy that prevents them from providing references. The other two agencies did not respond.
This work is to be performed on the airside of the airport. This area has aircraft traffic and all movement is controlled by the air traffic control tower. Due to the sensitive area this work is to be performed, it is imperative that the selected contractor be responsible and professional.
The Purchasing Division has deemed the lowest bidder East Coast Site Control as non-responsible based on the unfavorable reference check and the sensitive nature of the jobsite.
Options:
1. Approve the attached resolution authorizing the execution of the agreement with E.R.G.
Enterprises, L.L.C. for $32,800, or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Funds for this project have been budgeted and are available in the current budget year in the account number indicated.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH ERG ENTERPRISES FOR THE CLEANING OF AIRPORT RETENTION PONDS, PURSUANT TO BID NO. 70081; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an agreement with E.R.G. ENTERPRISES, L.L.C. whose address is 12111 Fieldstone Lane, Bayonet Point, Florida 34667, for construction services to clean retention ponds located at the Leesburg International Airport pursuant to Invitation to Bid 70081.
THAT this resolution shall become effective immediately.
