Subject:                      Resolution authorizing a Consent to Assignment of Lease among the City of Leesburg, John E. Freer and John Francis & Michelle Frances d/b/a Flying Colors of Leesburg

Staff Recommendation:

Staff recommends approval of the Consent to Assignment of Lease.

Analysis:

John Freer owns the T-hangar located at 8625 Airport Boulevard.  He wishes to sell the hangar and has entered into a contract for purchase of the hangar with John and Michelle Francis D/B/A Flying Colors of Leesburg.  The sale is contingent upon approval of the Consent to Assignment of Lease by the City of Leesburg.  The hangar will be used to house aircraft.  All terms of the original lease agreement, which will expire on December 31, 2009, will remain in effect.

This agreement was reviewed by the Airport Advisory Board at their March 21, 2007 meeting and recommended for approval.

Options:

1.  Approve the Consent to Assignment of Lease

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

Approval of this agreement will have no fiscal impact on the City of Leesburg.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONSENT TO ASSIGNMENT OF LEASE AGREEMENT AMONG THE CITY OF LEESBURG, JOHN E. FREER, AND JOHN FRANCIS & MICHELLE FRANCIS D/B/A FLYING COLORS OF LEESBURG FOR PROPERTY AT LEESBURG INTERNATIONAL AIRPORT; PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute a Consent to Assignment of Lease agreement with John Freer whose address is 78 Cypress Drive, Eustis, Florida 32726, and John Francis & Michelle Francis whose address is 8864 Airport Boulevard, Leesburg, Florida 34788, for property at Leesburg International Airport.

 THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 26th day of March 2007.
