Subject:                      Resolution authorizing a City Deed granting right-of-way on Hwy. 441 between Perkins Street and Griffin Road to State of Florida Department of Transportation.

Staff Recommendation:

Staff recommends approval of the City Deed to the State of Florida Department of Transportation.

Analysis:

This deed will grant right-of-way in an area on Hwy. 441 between Perkins Street and Griffin Road and is associated with a Florida Department of Transportation intersection improvement project in this area.

Options:

1.  Approve the execution of the City Deed, or

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

There will be no fiscal impact for the City.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE EXECUTION OF A CITY DEED BETWEEN THE CITY OF LEESBURG, AS GRANTOR, AND THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, AS GRANTEE FOR PROPERTY ALONG U.S. HIGHWAY 441 BETWEEN PERKINS STREET AND GRIFFIN ROAD; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            That the Mayor and City Clerk are hereby authorized and directed to execute a City Deed between the City of Leesburg, as grantor, and the State of Florida Department of Transportation, as grantee, in the form attached as Exhibit “A” to this resolution, conveying certain rights and interest of the City of Leesburg, Florida, in the right-of-way located on Parcel 122 & 122.1  (122.1 (along U.S. Highway 441 between Perkins Street and Griffin Road).

 THAT this resolution shall become effective upon its passage and adoption according to law.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the _26th____ day of _March________ 2007.
