Subject: Ordinance accepting a Quit Claim Deed from the State of Florida, Department of Transportation, Florida’s Turnpike Enterprise, for property at the CR470/Turnpike interchange
Staff Recommendation:
Staff recommends approval of the ordinance accepting the Quit Claim Deed from the State of Florida, Department of Transportation, Florida’s Turnpike Enterprise, for property at the CR470/Turnpike interchange.
Analysis:
The Florida Department of Transportation, Florida’s Turnpike Enterprise, has been working with Lake County and the City of Leesburg to transfer right-of-way at the 470/Turnpike interchange to these jurisdictions. The City has requested right-of-way in the northeast and southwest quadrants for the purpose of widening CR 470.
It is possible that the County will need a portion of the parcel in the northeast quadrant that the City is receiving for road widening. Since the CR 470 plans were not mature enough to determine their exact needs, the State has left that issue to negotiation between the City and the County.
The parcels were deeded to the City via two separate Quit Claim Deeds. The first deed was accepted by Ordinance on February 12, 2007. Acceptance of this Quit Claim Deed will complete this transaction.
Options:
1. Approve the ordinance accepting the Quit Claim Deed from Florida’s Turnpike Enterprise; or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
There is no fiscal impact as a result of this right-of-way transfer beyond general maintenance.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, ACCEPTING A QUIT CLAIM DEED FROM THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION, FLORIDA TURNPIKE ENTERPRISE, AS GRANTOR, TO THE CITY OF LEESBURG, AS GRANTEE, PERTAINING TO LAND LOCATED IN SECTION 17, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA AND LAND LOCATED IN SECTION 18, TOWNSHIP 20 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA that:
Section 1.
The City of Leesburg, Florida, does hereby accept from the State of Florida, Department of Transportation, Florida’s Turnpike Enterprise, a Quit Claim Deed dated November 21, 2006, and recorded on Official Records Book 3316, Pages 54-57, Public Records of Lake County, Florida, conveying certain real properties located in Section 17, Township 20 South, Range 24 East, Lake County, Florida and in Section 18, Township 20 South, Range 24 East, Lake County, Florida, to the City of Leesburg.
Section 2.
If any portion of this Ordinance is declared invalid or unenforceable, then to the extent it is possible to do so without destroying the overall intent and effect of this Ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of this Ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable.
Section 3.
This Ordinance shall become effective upon its passage and adoption according to law.
