Subject: Resolution approving a Conflict of Interests Waiver in the Walker Aviation v. Weller litigation
Staff Recommendation:
Staff recommends that the City Commission waive the potential conflict of interests in the case Walker Aviation v. Weller in order that the firm Bell & Roper, P.A. may represent the City of Leesburg, in the future, if the need arises.
Analysis:
Preferred Governmental Claims Solutions (PGCS), the City’s insurer, has hired Bell & Roper, P.A. to defend Charlie Weller in the Walker Aviation v. Weller litigation. Presently, Bell & Roper are representing the City in separate, unrelated litigation matters. They have requested that both the City of Leesburg and Charlie Weller waive “conflict of interests” so that they can proceed with representation. Mr. Weller has so waived. The response to the summons is due by April 13, 2007.
Options:
1. Approval of staff recommendation, or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Funds needed to represent the defendant will be billed to our insurer, PGCS.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, WAIVING ANY POTENTIAL CONFLICT OF INTEREST REGARDING LITIGATION ISSUES IN THE CASE OF RONN WALKER AVIATION SERVICES, INC. V. CHARLIE WELLER, CASE NO. 2007 – CA – 000449 IN LAKE COUNTY CIRCUIT COURT; AND PROVIDING AN EFFECTIVE DATE.
THAT the City Commission hereby waives any conflict of interest between the City of Leesburg and Charlie Weller in the case of Ronn Walker Aviation Services, Inc. v. Charlie Weller, Case No. 2007 – CA – 000449 in Lake County Circuit Court, which may arise as a result of the representation of the City in other matters by the firm of Bell & Roper, P.A., thereby allowing Bell & Roper, P. A. to represent Mr. Weller in the referenced litigation.
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 9th day of April 2007.
