SUBJECT: Ordinance correcting a scrivener’s error in legal description to Large Scale Comprehensive Plan Amendment: Serenby (Zoltan, Kennedy, Selway Farms
Staff Recommendation
The Planning staff recommends approval of the amendment to Ordinance No. 06-145 to correct the scrivener’s error in the legal description of the Future Land Use Map amendment for the Serenby property.
Analysis
The project site is approximately 127 acres. The general location is on the south side of CR 48, east of Bethel Baptist Church Road. This site was part of the 1st Cycle 2006 Large Scale amendments. The City Commission held the first reading on the Large Scale Comprehensive Plan Amendment for Serenby on May 22, 2006. Subsequently, the Commission adopted this ordinance on December 18, 2006. In revising the permanent Future Land Use Maps, staff determined the legal description was not complete due to a scrivener’s error. Staff has confirmed with the GIS Division that the enclosed legal description is complete.
Options:
1. Approve the amended ordinance to reflect the correct legal description for this site, which designates the site as City Estate Residential on the Future Land Use Map.
2. Such alternative action as the Commission may deem appropriate.
Fiscal Impact:
This large-scale comprehensive plan ordinance amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AMENDING ORDINANCE NO. 06-145 TO CORRECT A SCRIVENER’S ERROR IN THE LEGAL DESCRIPTION FOR THE AMENDMENT TO THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 127 ACRES AND GENERALLY LOCATED ON THE SOUTH SIDE OF CR 48, EAST OF BETHEL BAPTIST CHURCH ROAD, LYING IN SECTION 18, TOWNSHIP 20 SOUTH, RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN EXPANSION TO CITY ESTATE RESIDENTIAL AND CONSERVATION; AND PROVIDING AN EFFECTIVE DATE (SERENBY/ZOLTAN, KENNEDY, SELWAY FARMS)
WHEREAS, on December 18, 2006, the City Commission approved Ordinance No. 06-145 which amended the Comprehensive Plan for the City of Leesburg by changing the Future Land Use Map designation of approximately 127 acres generally located on the south side of CR 48, east of Bethel Baptist Church Road, from County Urban Expansion to City Estate Residential and Conservation
WHEREAS, a scrivener’s error in the legal description has resulted in the need to amend Ordinance No. 06-145 to accurately reflect the legal description;
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:
The Future Land Use Map is amended by changing the designation of an approximate 127 acre parcel of land generally located on the south side of CR 48, east of Bethel Baptist Church Road, lying in Section 18, Township 20 South, Range 25 East, Lake County, Florida, legally described as:

from County Urban Expansion to City Estate Residential and Conservation as shown on Attachment 1, the revised map of said area.
Section 2.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
Section 3.
This ordinance shall become effective upon its passage and adoption, according to law.
