Scale Comprehensive Plan Amendment: Moukhtara Legal
Description correction
Staff Recommendation
The
Planning staff recommends approval of the Ordinance amendment
to Ordinance No. 06-150 to correct the scriscrivener’sbners
error in the legal description of the Future Land Use Map amendment for the
Moukhtarra
property.
Analysis
The
project site is approximately 224 acres. The general location is south and east
of Lewis Road, west of CR 468. This site was part of the 1st
Cycle 2006 Large Scale amendments. The City Commission held the first reading
on the Large Scale Comprehensive Plan Amendment for Serenby on May 22, 2006.
Subsequently, the Commission adopted this ordinance on December 182, 2006. In revising the permanent Future Land Use Maps, it was
discoveredthe determination was made that due to
a scrivbner’s
error,
the legal description was not complete. Staff hasWe have
confirmed with the GIS Division that the enclosed legal description is
complete.
Options:
1. To approve the amended ordinance to reflect the correct legal description for this site, which designates the site as City Estate Residential and Conservation on the Future Land Use Map.
2. Such alternative action as the Commission may deem appropriate.
Fiscal Impact:
This large-scale comprehensive plan ordinance amendment will have no direct fiscal impact on the City of Leesburg.

AN ORDINANCE OF THE CITY
COMMISSION OF THE CITY OF LEESBURG, FLORIDA,
AMENDING ORDINANCE NO. 06-150 TO CORRECT A SCRIBVNER’S
ERROR IN THE LEGAL DESCRIPTION FOR THE AMENDMENT TOOF
THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, FLORIDA, CHANGING THE FUTURE
LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 224 ACRES
AND GENERALLY LOCATED SOUTH AND EAST OF LEWIS ROAD, WEST OF CR 468, LYING IN
SECTIONS 17 AND 20, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA,
FROM COUNTY URBAN AND URBAN EXPANSION AND CITY INDUSTRIAL TO CITY ESTATE
DENSITY RESIDENTIAL AND CONSERVATION; AND PROVIDING AN EFFECTIVE DATE (MOUKHTARATARRA/TARA
OAKS).
WHEREAS, on December 18, 2006, the City Commission approved Ordinance No. 06-150 which amended the Comprehensive Plan for the City of Leesburg by changing the Future Land Use Map designation of approximately 224 acres generally located south and east of Lewis Road, west of CR 468, from County Urban Expansion to City Estate Residential and Conservation
WHEREAS,
a scrivener’sbners
error in the legal description has resulted in the need to amend Ordinance No.
06-150 to accurately reflect the legal description;
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The Comprehensive Plan of the City of Leesburg, adopted by the City of Leesburg on September 22, 2003, pursuant to the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes, after public hearings by the City of Leesburg Planning Commission, is hereby amended in the following manner:
The Future Land Use Map is amended by changing the designation of an approximate 224 acre parcel of land generally located south and east of Lewis Road, west of CR 468, lying in Sections 17 and 20, Township 19 South, Range 24 East, Lake County, Florida, legally described as:
The Northeast ¼ of the Southwest 1/4:; the East ½ of the Southeast ¼ of the Southwest ¼; the South 1122 feet of the West ½ of the Southeast ¼ of the Southwest ¼; the North 198 feet of the West ½ of the Southeast ¼ of the Southwest ¼ less the West 25 feet thereof, in Section 17, Township 19 South, Range 24 East.
The Southwest ¼ of the Southeast ¼ of Section 17, Township 19 South, Range 24 East.
The Northwest ¼ of the Southeast ¼ , less the North 25 feet; the west 853.67 feet of the Northeast ¼ of the Southeast ¼ , less the North 25 feet; the South 853.67 feet of the East 466.33 feet of the Northeast ¼ of the Southeast ¼ ; the North 25 feet of the Southeast ¼ of the Southeast ¼ , less the west ¼ , in Section 17, Township 19 South, Range 24 East.
The Northwest ¼ of the Northeast ¼ of Section 20, Township 19 South, Range 24 East.
Alternate Key Numbers 1087589, 1772753, 3695291 and 1087571
from County Urban and Urban Expansion and City Industrial to City Estate Density Residential and Conservation as shown on Attachment 1, the revised map of said area.
Section 2.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
Section 3.
This ordinance shall become effective upon its passage and adoption, according to law.
