AGENDA MEMORANDUM
MEETING DATE: August 13, 2007
FROM: Laura McElhanon, AICP, Community Development Director
SUBJECT: Ordinance for Small Scale Comprehensive Plan Amendment for ECP Development, Inc. (Windy Oaks)
Staff Recommendation
The Planning staff and Planning Commission recommend approval of the proposed small-scale comprehensive plan amendment to the City’s adopted Growth Management Plan.
Analysis
The project site is approximately .1 acres. The property is generally located north of C.R. 48, west of C.R. 33 in the vicinity of South Quarter’s Road. The project site is ten (10) or less acres and is, therefore, considered a small-scale comprehensive land use plan amendment. The City will notify the Florida Department of Community Affairs of the plan amendment and the Department will review the project site area to confirm that it is ten (10) acres or less. At that time, the Department will determine that it is a local issue and not subject to Department review.
Currently, the property is undeveloped and the proposed use is open space for existing PUD (Planned Unit Development). The surrounding City Future Land Use Map designations are to the north County Urban Expansion, and to the east, west and south City Estate. The existing Land Use designation for the property is County Urban Expansion. The proposed future land use designation of City Estate is consistent with the City’s adopted Growth Management Plan and would allow for the expansion of an existing business.
The Planning Commission held a public hearing on the application on June 21, 2007 and by a vote of 7 to 0, recommended approval.
Options
1. Approve the requested small scale comprehensive plan amendment to City Estate.
2. Other such action as the Commission may deem appropriate.
Fiscal Impact
There is no fiscal impact to the City.
