Subject:                      Ordinance amending Section 2-162 of the Code of Ordinances revising the residency requirement for voting members of the Leesburg International Airport Advisory Board

Staff Recommendation:

Staff recommends approval of the Ordinance amending Section 2-162 of the Code of Ordinances pertaining to the Leesburg International Airport Advisory Board.

Analysis:

As currently written, the Code of Ordinances requires the five members of the Airport Advisory Board to reside within the City of Leesburg utility area.  There have been several instances where individuals who were initially chosen for this Board by a Commissioner could not be appointed simply because their residence was located outside of the City’s utility area.  These individuals were otherwise very well qualified to serve on this Board.

After reviewing this situation, staff felt the residency requirement for this Board should be changed.  Staff determined that replacing the current utility area requirement with a twenty (20) mile radius would allow a much greater area from which to select potential Board members.  This is the same residency requirement currently used by the City for police, fire and other on-call personnel.

Options:

1.  Approve the ordinance amending the Code of Ordinances Section 2-162, or

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

Members of this Board volunteer their time.  There will be no fiscal impact to the City as a result of this change.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING SECTION 2-162 OF THE CODE OF ORDINANCES OF THE CITY OF LEESBURG, FLORIDA; PERTAINING TO COMPOSITION OF THE LEESBURG INTERNATIONAL AIRPORT ADVISORY BOARD AND THE APPOINTMENT, QUALIFICATIONS AND TERM OF MEMBERS; REVISING THE RESIDENCY REQUIREMENT FOR VOTING MEMBERS OF THE LEESBURG INTERNATIONAL AIRPORT ADVISORY BOARD; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:

SECTION 1.

            Section 2-162(d), of the Code of Ordinances of the City of Leesburg, Florida, is hereby amended to read as:

            (d)        Each member of the Advisory Board shall reside within a twenty (20) mile radius of                                    the intersection of the center lines of Main Street and U.S. Highway 27 in Leesburg,                                    Lake County, Florida.

SECTION 2.

            All ordinances or parts of ordinances which are in conflict with this ordinance are hereby repealed, to the extent necessary to alleviate the conflict, but shall continue in effect insofar as they are not in conflict herewith, unless repealed or the conflicting portions destroys the overall intent and effect of any of the conflicting ordinances, in which case those ordinances so affected shall be hereby repealed.

SECTION 3.

            If any provision of this ordinance is declared invalid or unenforceable, then to the extent it is possible to do so without destroying the overall intent and effect of this ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of this ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable.

SECTION 4.

            This ordinance shall become effective upon its passage and adoption according to law.
