SUBJECT: Ordinance for vacating a portion of the North Leesburg Subdivision No.1 and Picciola Park subdivision plats
Staff Recommendation:
The Planning staff and Planning Commission recommend approval of the request to vacate a portion of the North Leesburg Subdivision No.1 and Picciola Park subdivision plats. The area to be vacated is not currently used for public access and is undeveloped. It is not needed for future access and should be vacated to allow the property to be development.
Analysis:
These subdivisions were platted in 1926. No development has occurred on the property and the roads were never constructed. The vacation of portions of these subdivisions is requested by Miguel Soto, the owner of the property, to allow for the development of a multifamily complex (condominium and/or rental). All required utility easements will be provided by the applicant in other areas of the development where necessary, in addition to easements that are proposed in the new Plat to be approved on this site.
By a vote of 7 to 0, the Planning Commission recommended approval.
Options:
1. Approve the request to vacate the portions of the referenced subdivisions..
2. Other action the Commission may deem appropriate.
Fiscal Impact:
No fiscal impact is anticipated as a result of the vacation of these subdivisions.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, VACATING A PORTION OF THE NORTH LEESBURG SUBDIVISION NO. 1 AND PICCIOLA PARK SUBDIVISION PLATS AS RECORDED RESPECTIVELY IN PLAT BOOK 8, PAGE 98, AND PLAT BOOK 9, PAGE 8 PUBLIC RECORDS OF LAKE COUNTY, FLORIDA, SAID PROPERTY GENERALLY LOCATED EAST OF PICCIOLA ROAD, NORTH OF CITRUS BLVD AND SOUTH OF PARK HOLLAND ROAD, LYING IN SECTION 15, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The City Commission of the City of Leesburg, Florida, finding that portions of the North Leesburg Subdivision No.1 and Picciola Park Subdivision Plats, subdivisions in Lake County, Florida, are not needed for public purposes, therefore the portions of said North Leesburg Subdivision No.1 and Picciola Park Subdivision Plats, legally described below are hereby vacated and relinquished, and except as reserved hereinafter:
Section 2.
The City Commission specifically reserves in perpetuity, for the use and benefit of the City of Leesburg, utility easements for any areas where there are utility lines (above ground or underground) now in existence on the property, as well as utility easements over and across any and all roads, streets and alleys otherwise vacated by this Ordinance.
Section 3.
This ordinance shall become effective upon its passage and adoption according to law.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Leesburg, Florida, held on the ______ day of ______________, 2007.
