Subject: Resolution for amending an Annexation Agreement to annexed property for ECP Holdings, LLC formerly Richard & Betty Lasher (Windy Oaks)
Staff Recommendation:
Staff recommends approval of the proposed amended annexation agreement.
Analysis:
As a result of an error in the legal description provided by the applicant for the property of approximately 61 acres of land annexed in the City, an amended Annexation Agreement has been prepared to address the error. This amended Agreement provides:
· A corrected Exhibit “A” Legal Description.
Options:
1. Approve the requested amended annexation agreement.
2. Disapprove the proposed amended annexation agreement.
Fiscal Impact
There is no fiscal impact as a result of this action.

RESOLUTION NO.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDED ANNEXATION AGREEMENT WITH ECP HOLDINGS, LLC; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk of the City of Leesburg are hereby authorized and directed to execute the Annexation Agreement between ECP Holdings, LLC and the City of Leesburg, Florida, in the form attached as Exhibit “A” to this resolution.
That this Resolution shall be effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 27th day of August 2007.

PARCEL NO. 1:
