Subject:                      Resolution authorizing US Customs and Border Protection Overtime Fee to Inspect and Clear an Aircraft at Leesburg International Airport

Staff Recommendation:

Staff recommends approval of the overtime fee increase. 

Analysis:

In September 2005, the City Commission approved Resolution 7444 which states the charges for the US Customs and Border Protection (CBP) officer to inspect and clear aircraft at Leesburg International Airport. This Resolution specifies the standard fees and overtime fee that can be charged for aircraft inspection and clearance.

Recently, the airport’s CBP Officer advised that his salary has increased since he was originally assigned to Leesburg International Airport.  He recommended that the overtime fee that is charged for his services should be increased to keep pace with his actual pay rate.  The proposed fee schedule does not revise the standard fees – only the overtime fee that is charged when a CBP officer is requested to be on-site outside of normal working hours.

The overtime fee is currently $110.00.  This amount is charged in addition to the standard fee for each particular type of aircraft.  Staff proposes to increase the overtime fee from $110.00 to $140.00.  The increased amount will more accurately reflect the salary for the existing CBP officer.  The increase will be effective November 1, 2007.

The Airport Advisory Board discussed this item at their September 12, 2007 meeting and recommended approval.

Options:

1.  Approve the overtime fee increase.

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

Approval of the new overtime fee will have no fiscal impact on the City of Leesburg.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AMENDING THE FEE SCHEDULE IN RESOLUTION 7444 FOR AIRCRAFT INSPECTION AND CLEARANCE AT LEESBURG INTERNATIONAL AIRPORT BY THE US CUSTOMS AND BORDER PROTECTION; AND PROVIDING AN EFFECTIVE DATE.

            WHEREAS, the City of Leesburg has contracted with the U.S. Customs and Border Protection for aircraft inspection and clearance at Leesburg International Airport; and

WHEREAS, the City of Leesburg currently offers the U.S. Customs and Border Protection aircraft inspection and clearance to aircraft owners; and

WHEREAS, the City of Leesburg now desires to amend Resolution 7444 and adopt a revised fee schedule increasing the Overtime Fee for the U.S. Customs and Border Protection aircraft inspection and clearance services.

NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Leesburg:

            That the following table is adopted as the U.S. Customs and Border Protection Standard Inspection Fee Schedule of the City of Leesburg, and shall remain in effect as such until modified or repealed by subsequent resolution of this body.

THE STANDARD FEE SHALL APPLY DURING THE NORMAL WORK SCHEDULE, WHICH SHALL BE MONDAY THROUGH FRIDAY, FROM 8:30 A.M. TO 5:00 P.M.  ANY INSPECTIONS DONE OUTSIDE OF THESE TIMES SHALL BE SUBJECT TO AN OVERTIME FEE OF $140.00 IN ADDITION TO THE STANDARD FEE.

            THAT this resolution shall become effective November 1, 2007.
