Subject:                      Resolution authorizing termination of an Interlocal Agreement with Lake County for intersection improvements at Main Street and Lake Street

Staff Recommendation:

Staff recommends termination of the Interlocal Agreement with Lake County for improvements to the Main and Lake Street intersection.

Analysis:

The City of Leesburg was asked to evaluate the intersection of Main Street and Lake Street to determine if improvements are needed.  Information gathered from the investigation included crash history, roadway features, which include center line geometry, curb return radius, sight triangles, super elevations, pavement structures, cross slopes, longitudinal grades, drainage and right of way.  The study concluded that no changes to the roadway are recommended at this time.

The Interlocal Agreement states Lake County  will reimburse Leesburg for the costs associated with the study.  The County requested  the City Commission take  formal action to terminate the agreement, and at that time they County will reimburse the City $14,550.00 for the cost of the study.

Options:

1.      Terminate the Interlocal Agreement with Lake County, approved by Resolution No. 7714,  at the August 28, 2006 Commission meeting; or

2.     Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

Funding of $14,550 was available to advance this project, and Lake County will reimburse the City  for the study.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG AUTHORIZING CANCELLATION OF THE INTERLOCAL AGREEMENT WITH LAKE COUNTY BOARD OF COMMISSIONERS FOR  DESIGN AND INTERSECTION INMPROVEMENTS  AT THE INTERSECTION OF  MAIN STREET AND LAKE STREET; AND PROVIDING AN EFFECTIVE DATE.

            WHEREAS, The City Commission adopted Resolution 7714 for intersection improvements at Main Street and Lake Street August 28, 2006; and

            WHEREAS, a study was conducted to determine the necessity of the intersection improvements

            WHEREAS, the study recommends not proceeding with the project,

            WHEREAS, it is necessary for the Commission to take formal action to terminate the agreement for the City to be eligible for reimbursement of the study of $14,550.00

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the City Commission  hereby formally cancels the Interlocal Agreement with Lake County Commission for payment of design of improvements to the Main Street and Lake Street intersection.  Lake County Commission, P. O. Box 7800, Tavares, Florida 32778

 THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the _26th____ day of __November_______ 2007.
